Dear Sirs
The fallowing petition was heard at a meeting of the Board of Appeals an Monday evening,
January 11, 1965 at the Town Office Building. Members present and voting ueres
Daniel T. O'Leary, Chairman; Willies Morton, Secretary; Remy 2. Lurmd, John J. Shields
and Arthur Drummond,
JOEN J. WILLIS requested a special permit and a variation of Sec. 4, Para. 4.11 (a) of
the Zoning BT-Saar se as to permit the seaversion of an existing duplex house into four
apartments, on the promises, located at the gest side of lain Street; 300 feet distant
from the corner of Water Street and known as 1179-1.81 Yalu Street,
This public hearing was advertised in the Nagle Tribume on December 28, 1964 sad Jam-
uary 4, 1965. An abutters were duly notified by certified mail of this hearing.
The petitioner, Atty. John, J. Willis, appeared before the Board and outlined his ob-
jective, to convert a presently existing lame, older styled, duplex dwell.irmg, with
the main structure being 2* steries in height and a T-shape rear structure being 1}
stories in height, into a four dwelling unit structure, He presented a site plan of
land prepared by Brasseur Associates , Haverhill, Mass. dated December, 1964. No
also presented a preliminary flow plan of the existing dwelling with limited arohi-
teeteral details generally outlining the ram arrangement and physical use of each
dwelling unit.
The aforesaid floor plan indicates a conversion on the first floor of a dwelling 'rant
consisting of four rooms and one interior bath, each balAggsaduplicate for the north
and south sections of said duplex unit. The plan further indicated that on the south
side second floor there would be a dwelling unit of four roods and one bath and on the
north side a dwelling unit of three roads and one bath. The plan further indicated an
addition on the rear of the upper floor and when questioned, it was indicated that a
platform landing and two sets of stairs, one running south and ono running north, was
proposed to be installed.
The petitioner indicated to the Board that there was a need currently existing for
lower cost dwelling units, centrally located, near community facilities and partiou-
larly near churches. That no exterior modification of the building would be nomb.
That the appearance of the building from any passosr-by would indicate original coax
struction as a duplex dwelling unit which is not uncommon in the immediate neighborhood.

Upom question by Board member Shields as to a eloadfication of a detail in the
rear bedrooms of the dwelling units located an the second floor, the petitioner
responded that they indicated existing windows. Board Member Shields explained an
inadequacy of the use of existing windows as a suitable and current pervissifte use
9fide3e,sj*Wable law and that a full passage door would be a necessary requirement
in the conversion of the proposed dwelling units in order to provide two acceptable
means of egress fron the second floor dwelling units. The petitioner, a practicing
attorney, advised the Board that requirements of egress or other pertinent require-
ments for dwelling waits was net a matter of consideration for the Board.
No one appeared in objection to the petitiaa.
Upon motion of William Martex, the petition vols taken under advisement, The Beard,
in faeoutive session, considered the statements of time petitioner, with respect to
their authority as outlined by Atty. Willis, wherein their responsibilities and
authority were limited only to the provisions of the required square feet per dwelling
unit and to required set-backs and lot size where the varieas robing requirements as
outlined in the Zoning By-law of the tows of Horth Andover, Mass,
This Award wishes to review their authority, which is set forth in Section 1 at the
present Zoning By-law, particularly on time following excerpt of said Section *For the
purposes set forth in Massachusetts General Laws, chapter 4D and all auto in-am nd-
meat thereof and in addition thereto and under the authority thereof and of. the General
Laws, Chapter 143 and NM other e2abl32g Taws, the inspection, materials, construction,
alteration and repair, .height, ,area.,location and use of buildings and structures and
the use of land, throughout the Town of Horth Andover are hereby regulated as herein
provided."•
It is the opinion of this Board that the provisions of Para. 4,7 does came muter the
requirements of the General Laws, Chapter 143, which pertains to public safety.
This Board further contends that under the provisions of Section 4.7, that Art. 2 of
the State Sanitary Code adopted and made a provision of Section 5 of chapter 111 of
the General Laws as amended by Chapter 522 of the Acts of 1959 and by Chapter 172 of
the Acts of 1960 are matters of consideration for the Zoaixg Board of Appeals, That
said Sanitary Code is a current prevailing law which takes precedence ever the Wai-
man mini-
manstandards of fitness for human habitation which was adopted by the town of North
Andover Mader the authority of General Laws, Chapter 111, Section 12$-G" and whInk be-
came effective June 10, 1959. This Board ooneludes that in the considering of any
petition for the granting of permissive use which creates dwelling =its within the
scope of the State Sanitary Cade or public safety of the inhabitants of the town of
North Andover. That they have a prim® responsibllity to insure that approval of said
permissive use will encompass all applicable provisions thereof,

It was moved by Mr. Shields, that the petition be GRUTO provided all enabling :Lags
pertinent to said petition be made a requirement for full compliance by the petitioner
and that the petitioner submit a detailed architectural not of p]ams to the Building
Inspector, outlining the dwonlug units proposed and indicating thereon seek infor-
mation as will insure adequacy of compliance with the Building Code and the Sanitary
Code. And to more specifically require an acceptable second meam of egress from.
the second floor dwelling mmits which is hereby designated to be an unobstructed
medium of egress and more specifically, a full passage door.
That a copy of this decision to be furnished to the Building Imposter and the Board
of Health, the town agencies charged with insuring compliance with various enabling
laws. Mr. Lund seconded the notion and the vote was mus.
