Permit Process,
Dear Mr . Long,
The North Andover held a Public Hearing on Monday evening,
March 2, 1987 at 8:00 p.m, in the Town Hall Meeting Room upon the
application of Michael J. Quinn. The Hearing was advertised in the
North Andover Citizen on January 15 and January 22, 1987. The
following members were present at the March 2, 1987 meeting : Erich
W. Nitzsche, Chairman; Michael P. Roberts, Vice Chairman; John
Simons, Clerk, Paul Hedstrom and John J. Burke.
The petitioner seeks a Special Permit under Section 8,
paragraph 3; Site Plan Review of the North Andover Zoning Bylaw.
The purpose of the Site Plan special permit is to review the
proposal to alter the use of the building at 129 Main Street,
formerly Finneran' s Pharmacy, to allow a Dunkin Donuts to occupy
the front section of the building and to review the proposed
parking for the site. The site is located on the west side of Main
Street between the Post Office ( which is actually part of the same
structure) and the Messina' s Shopping Center . Said lot possesses
16,641 square feet of land area with 61.42 feet of frontage on Main
Street in a General Business zoning district.
At the Public Hearing, the applicant, Michael J. Quinn, the
architect, Skip Sagris and representatives from Dunkin Donuts
corporate offices appeared before the Planning Board to present the
site plan. Parking on Main Street was discussed including the
possibility of moving the bus stop from its present location across
from the entrance to Town Hall to a better location, therefore
providing additional parking spaces on Main Street and avoiding the
problem of people illegally parking in the bus stop to run into
Dunkin Donuts. The sign and illumination were also discussed.

The following members were present and voting at the March 16 ,
1987 meeting when they rendered their decision: Erich Nitzsche,
Chairman, Michael Roberts, Vice-Chairman, John Simons, Clerk, Paul
Hedstrom and John Burke. Upon a motion made by John Burke and
seconded by Michael Roberts, the Board voted unanimously to grant
the petition for site plan approval under the Special Permit
process for Dunkin Donuts at the request of Michael Quinn with the
folowing conditions :
1. ) Parking spaces will be clearly marked to reflect the
loading zone, the employee parking and customer parking.
2. ) A sign will be placed so that it is visible to Main Street
traffic indicating that there is parking in the rear of
the building, to be reviewed by the Planning Board staff.
3. ) The main entrance to the building will be placed on the
corner of Main Street and School street.
4. ) The applicant will coordinate with the owner and other
occupants of the building to landscape the rear property
line to provide a buffer between this site and the
adjacent residential uses. Said plan detail shall be
reviewed and approved by the Planning Board.
5. ) The applicant will provide and continuously maintain
landscaping according to the Plans.
6. ) The applicant will install a wooden sign be in place of
the plastic sign. The Planning Board will approve sign in
writing before it is installed. Illumination of the sign
is to be reviewed by the Planning Office.
7. ) The applicant will provide a fence to enclose the dumpster
in accordnace with the site plan.
8. ) The applicant shall date the final set of plans.

Works, and the Board of Health.

In granting the Special Permit, the Planning Board finds, pursuant
to section 10. 31 - Conditions for approval of Special Permits of
the Zoning Bylaw, that the following conditions are met:
a) The specific site is an appropriate location for such a use
since it is a general business district in the downtown area of
North Andover ;
b) The use as developed will not adversely affect the neighborhood
as 'it is surrounded by other general business uses and will
provide a buffer between the use and its residential neighbors
to the rear of the property;
c) There will be no nuisance or serious hazard to vehicles or
pedestrians , since the applicant has provided a parking and
circulation plan;
- Based on site visits, the public hearing process, and review
and input by Town Boards, and departments, the proposed use
which is permitted in section 4 . 128 General Business
district, is considered to be in harmony with the general
purpose and intent of the Bylaw.
