John J. Lyons, Town Clerk Town Office Building North Andover, Mass. Dear Sir: With Atty. Joseph Miragliotta, Associate Member, sitting in place of Daniel T. O'Leary on the Zoning Board of Appeals along with Arthur R. Drummond, Chairman; Donald J. Leonard, J. Philip Arsenault, Esq. and Atty. James A. Glynn, Jr., Assoc. Member, the request as advertised in the Lawrence Eagle-Tribune on June 20 and 27: 1970, of Dr. William Patterson was considered at the meeting held on Tuesday, July 7, 1970 in the Town Office Building. All abutters were duly notified of the hearing. DR. WILLIAM PATTERSON requested a variation of Section 7.22 of the Zoning Bir-Law so as to permit the erection of a duplex house on the south side of Highland Terrace at the corner of Wilson Road and was represented by Atty. John J. Willis. The location is zoned Country Residential. The building would be one story, 70 feet by 30 feet and 20 feet high and would be for residential use only. While no actual opposition was noted by the Board, among those that commented on the request were Mr. and Mrs. Frank Lewis, Daniel O'Leary, Walter Wilson and Maurice Lynch. Atty. Willis stressed the fact that the petitioner was prevented from com- plying with the law because the town of North Andover has a drainage pipe without benefit of an easement through the lot involved. The letter from the Building Inspector noted that the land was not being divided to provide separate lots for the two dwellings (the existing structure and the proposed new one). After a lengthy discussion while under advisement, the Board unanimously voted to DENY the variance upon motion of J. Philip Arsenault and seconded by Donald J. Patterson 256 Turnpike Street Petition No. 3 — '72 John J. Lyons, Town Clerk Town Office Building North Andover, Mass. Dear Sir: A public hearing was held by the Board of Appeals on February 14, 1972 upon applica— tion of DR. WIIaJAM J. PATTERSON who requested a variation of Section 7.22 of the Zoning By—Law so as to permit the erection of a single family dwelling on the premises located at the west side of Highland Terrace at the corner of Wilson Road. The following members were present and voting: J. Philip Arsenault, Esq,, Chairman; Kenneth E. Pickard, Vice Chairman; Arthur R. Drummond; Frank Serio, Jr. and Associate Member James 'A. Glynn, Jr., Esq. who sat in place of Dr. Eugene A. Beliveau. The hearing was advertised in the Lawrence Eagle—Tribune on January 29 and February 5, 1972 and all abutters were duly notified by regular mail. Dr. Patterson spoke in his own behalf and explained that he needs a variance for setbacks in order to properly place the house on the "L" shaped lot. There are sewerage facilities on the street. He feels that the lot is of adequate size; other homes on the street have 20 feet frontage or less. This will be the last buildable lot', in the neighborhood. Many of the other structures in the area do not conform; some,are closer to the lot lines than what he is asking. He said the last three dwellings built in the area are on lots smaller than his. There is 156 feet frontage on the street. The character of the neighborhood is village residential. He needs a 20 foot front setback and 15 foot sideline setback and this will be a single family house. No one else spoke and there was no opposition. The petition was taken under advisement and the board discussed the merits of the petition. Mr. 'Glynn made a motion" to GRANT the variance for a single family residence and the condition that part of the garage shown on the plan be razed. Mr. Pickard seconded the m4tion and the vote was unanimous. The Board found that the lot was unique in that it was irregularly shaped and that it would be difficult for the petitioner to 'so position the building on the lot to comply with the setback and Y Dr. William J. Patterson —2- March 6, 1972 and sideline requirements. Allowance of the variance would not substantially derogate from the requirements of the By—law nor be detrimental to the area in that there are a number of lots in the neighborhood that have less than the re— quired number of square feet and on which lots buildings are placed closer to the lot lines than the By—law requires. Andover, MA 01845 ** DECISION * The Board of Appeals held a public hearing on February 9, 1988, continued to March 8, 1988 and decision rendered on March 14, 1988 on the application of William J. Patterson requesting a hearing, as a PARTY AGGREIVED regarding violation of Section 9.1 by issuance of a building permit at 246 Turnpike Street for construction of sheds. The following members were present and voting: Frank Serio, Jr. , Chairman, Alfred Frizelle, Vice-chairman, Walter Soule, acting Clerk, Anna O'Connor and Louis Rissin. The hearing was advertised in the North Andover Citizen on January 21 and January 28, 1988 and all abutters were notified by regular mail. Upon a motion made by Mr. Frizelle and seconded by Ms. O'Connor, the Board voted to GRANT the Party Aggreived petition as requested, and hereby directs the Building Inspector to REVOKE Building Permit 44453 issued to John & Eileen Markey on 12/16/87. Mr. Serio voted in opposition to this petition. The Board finds that Building Permit #453 issued to John & Eileen Markey was in error and should be revoked. Dear Sir: A public hearing was held by the Board of Appeals on October 18, 1971 upon appli- cation of DR. WILLIAM J. PATTERSON who requested a variation of Section 6.32 of the Zoning By-Law so as to permit the division of a parcel of land into two lots having less than the required area; on the premises located at the east side of Turnpike Street at the corner of Wilson Road and known as 256 Turnpike Street. The following members were present and voting: J. Philip Arsenault, Esq., Chairman; Kenneth E. Pickard, Vice Chairman; Dr. Eugene A. Beliveau, Secretary; Arthur R. Drummond and Associate Member William N. Salemme who sat in place of regular member Frank Serio, Jr. The hearing was advertised in the Lawrence Eagle-Tribune on October 2 & 9, 1971 and all abutters were duly notified by regular mail. Dr. Patterson, spoke in his own behalf and explained that the entire area contains 25,588 sq. ft. and he wants to make two lots, one to contain 12,522 sq. ft. and the lot upon which his home presently stands, to contain 13,066 sq. ft. Both lots have the required frontage but not enough area. The existing homes in the immediate area are on lots of less than 10,000 sq. ft. There are now sewerage facilities in the area. There is a hardship because the land is not being utilized to its fullest. The formation;of these lots would not be detrimental to the area and would not derogate from the intent of the Zoning By-Law. He would like to erect a single family dwelling on the vacant lot. He presently lives in the two-story dwelling and operates his dental business there. The new dwelling would be for himself. At the time the prop- erty was purchased there were five separate lots (in 1956). Chairman Arsenault questioned whether this was a proper petition since a petition for this same property had been before the Board within the past two years and had been denied. Dr. Patterson assumed he was acting properly since the previous petition was for a different reason. No one else spoke and there was no opposition. The petition was taken under advisement and during this period was reviewed by the Board. The Board voted on whether or not it was a proper petition to appear before the Board, upon motion by Mr. Pickard; Mr. Drummond seconded the motion and the vote was 4 - 11 with Chairman Arsenault voting no. Mr. Pickard then made a motion to GRANT the variance; Mr. Drummond seconded the motion and the vote was 4 - 19 with Chairman Arsenault voting no. � e e Dr. William J. Patterson —2 November 9, 1971 The Board found that the lot was sufficiently unique in the area in that it was much larger than the adjoining lots and that the petitioner would suffer a financial hardship should the petition be denied. The variation was not sub— stantial in that it met all other provisions of the By—Law with respect to sideline, setback, frontage and rear yard requirements. It was not a substantial derogation from the intent of the By—Law in that the proposed lot would be substantially similar to many other lots in the neighborhood already built upon. Dear Sir: A public hearing was held by the Board of Appeals on April 10, 1972 upon application of DR. WILLIAM J. PATTERSON who requested a variation of Sec. 6.32 & 7.22 of the Zoning By—Law so as to permit the erection of a single family dwelling located at the west side of Highland Terrace at the corner of Wilson Road. The following members were present and voting: J. Philip Arsenault, Chairman; Kenneth E. Pickard, Vice Chairman; Dr. Eugene A. Beliveau, Clerk; Arthur R. Drummond and Frank Serio, Jr. The hearing was advertised in the Lawrence Eagle—Tribune on March 25 & April 11 1972 and all abutters were duly notified by regular mail. Dr. Patterson spoke in his own behalf and explained that he had appeared before the Board twice to have his land divided. He said there was an error in the number of square feet shown on the plan that had been previously approved by the Board. He wanted the bots to be more equal in size and also divided in such a way as to allow for the proper placement of the new dwelling on the vacant lot. No one else spoke and there was no opposition. The petition was taken under advisement and further reviewed at a Board of Appeals meeting on May 8, 1972 with the same members present. Mr. Serio made a motion to GRANT the variance; Mr. Pickard seconded the motion and the vote was unanimous. The Board found that the lot was uniquely shaped so that a change in the boundary would benefit both lots and the requested variances were not substantial in nature and would permit the erection of a single family residence on the lot. The setback and sidelines would be in keeping with the presently existing pattern in the immediate neighborhood and therefore the neighborhood would not be affected in an adverse way.
