Upon application of Demetrious Pavledakes to the North Andover Board of App"In for a variance under Section 6.3 of the North Andover Zoning By-Uva no as to permit the division of a parcel of land into two lots having less than the required frontage and area, a public hearing was held June 12, 1967 by the Borth Andover Board of Appeals. The hearing was held in the Town Hall facilities after having been advertised in the Lawrence Eagle Tribune on the dates; May 27 and Jerre 3, 1967 and with all abutters duly notified by certified mail. The members of the Board present and voting were: dames A. Deyo, Chairman; Arthur Drummond, Secretary; Daniel T. O'Leary, Jobn J. Shields and Donald J. Scott. The applicant pleaded his own case stating that the division of the lot into two parcels would not be out of line with the surrounding neighborhood. Denial of the petition would cause him financial hardship in that he wished to convey the property to his son so that he could build a home upon it. There more no objections heard at the hearing and a letter from an abutter was noted as being in favor of the petition as presented. A motion was made and carried that the application be taken under advisement. During this period it was noted that there was a garage almost on the proposed new lot line. The general feeling of the Board was to granting the petition Vere it not for the existence of said garage. Accordingly, and so as not to impose an unnecessary burden on the petitioner, it was decided to request the petitioner to attend the next sitting of the Board to discuss the problem of the garage. At this later time (July 10, 1967) the petitioner agreed to rase the garage as it was not a substantial building if this action was desired by the Board or made a condition to the granting of the variance. A motion was made by Member Daniel T. O'Leary to GRW the variance, was seconded by Member Arthur Drummond and voted unanimously by the Board. The principal reasons for granting the variance are as foll.owat - i _ -,2- August 3, 1967 Pavledskes 1. Denying the petition would cause financial hardship to the petitioner, 2. Division of the lot will create two lots well in keeping with the surrounding neighborhood. 3. That granting this variance mould not deviate from the intent and purpose of the Zoning By—Laws. A condition attached to the variance is that no building permit may be issued for any structure on the newly created lot unless the existing garage on the southeast corner of the north lot has been rased.
