Meeting was called to order b. the chairman at 7:30 ).m. Members present

On motion of Hr. NicetLa~ seconded by ~[r. Lund the board unanimously voted
~o have 20,3 copies of k, he rules and regulations mimeographed.

On motion of Mr. S~i. th secomded by Mr. Perrone~ the Board voted,whet~er ordnot
to appeal the cour~ decision. 'Messrs. S~ith and Perrone were recorde4 as being
in favor of appealing~ Messrs. Whipple, Finck and Nicetta were recorde, d as
being o~posed to appealing. Notion to appeal was defeated 3 to 2.
The msetin~ adjourned at 8:30 p.m.

The meeting was calledto order by the chaiman at 7:3Op.m. Members present were
M~..Finck, Mr. Perron% Mr. Smith, Mr. Nicetta, Mr. Alvino~ and Mr. Whipple, chair-
man. Mr. Smith and Mr. Perrone were designate'd as voting members in absence of
the regular m~mbers.
Mr. John Willis, Esq. appeared in behalf of Mr. Daniel B. McDuffie who requested a
variance in connection with a change he wishes t~ make in a dwelling at 44-6
~on Street. Mr. Willis presented a petition sighned by his client and the abutta, s
of the land in question stating they are in favor of such a change beinA~ade. Mr.
Willis presented two cases which he stated were similar to Mr. McDuffies which he
stated might aid the Board in acting favorably for bis client.
1. Sellers vs Concord - 329 Nass. 259
2. Evipure vs Lawrence - 324 Mass. 433
Mr. Willis also said that there are mar~ multiple dwellings in the same neighborhood
including the Veterans~ HOUsing Project. On motion of Mr. Perrone seconded by Mr.
Smith the Board unauim~as]~V voted to take the matter under advisement.
Mr. Simon L. Caponette, 72 Harold Street appeared requesting a variance for the
cons tr~ct~ on of a dwelling to allow a sideline of less than required by t~
By-Laws as the land is not the right size. Appearing with Mr. Capomette
was Mr. Broadhurst who presently owns the land.
On motion of Mr. Nic~ta seconded by Mr. Finck the Board unanimously voted to
take the matter under advisement.
On motion of Mr. Sm~' ~ seco~ed by Mr.~am~.' ~he Board unanimons!y voted
to grant the variance ~nder~ the ~ers granted b~ A~ticl,e 6~ Section IA of
the By*laws and for the follo~ing reasons:
If the plan of land was duly recorded in the
Registry of Deeds prior to the effective date
of the By*laws
2. Since the lot is narrow and cannot meet the re-
quirements of Article 4, Section 2~ Paragraph B
and Section 3 of the By~L~ws
3. It does not appear that auy building will be able
~o be erected on the lot unless the variance is
granted.
In the case of Daniel McDuffie...on motion of Mr. Perrone seconded by
Mr. Smith the Board voted to postpone s. ction on this case until the
next regular meeting.
On motion of Mr. Nicetta seconded by Mr. Fihck the ~oard voted to adjourn
at 10:30 p.m.
