Dear Yr. Long:
A public hearing was held by the Board of Appeals on March 10, 1980 upon application
of Frank and Virginia Peluso who requested a variation of Section 7.1 and Table 2
of the Zoning; By-Law so as to permit a division of an existing lot into two lots
on the premises located at the north side of Rea St., known as 545 Johnson St. and
shown on a plan dated January 3, 1980. The following members were present and
voting: Frank Serio, Jr., Chairman; Alfred E. Frizelle, Esq., Vice-Chairman;
R. Louis DiFruscio, Clerk; Augustine W. Nickerson and Walter F. Soule, Assoc.
Members.
The hearing was advertised in the North Andover Citizen on Feb. 21 & 28, 1980 and
all abutters were duly notified by regular mail.
At the hearing the petitioner testified that he wanted to divide the lot to enable
his daughter to construct a dwelling. The division would leave one lot with
approximately 5,200 s.f. (more or less) than required under the By-Law. The hard-
ship as described by the petitioner was financial to him since his daughter is
unable to purchase property and build a house.
A number of abutters spoke in opposition to the granting of the petition citing,
amongthings, ar duction in property valuer Poor roil,
and existing
water
problems.
On motion made by Frizelle, seconded by Nickerson the Board voted 4-1 to DENY the
request. The Board found that the petitioner had not satisfied each of the require-
ments of Section 10.4 of the By-Law.

u,'e are requesting that you reconsider your rejection
of our :eti ti on No. 440 for the variance . Gur daughter,
who has been -raiserand educated in our town' s school
systei,i, wishes to continue to live in town and eventually
raise I-er family here. As you w6ll know, the cost of
housing, in our town is out of sight. The variance at this
point is a very necessary factor, for �%�ithout it there is
no ,';ay these kids can possibly buy lard and build a house .
Lhat young married couple could possibly afford the cost
without sone help from their parents .
;,e had a perk test done by Andover Consultants in
December, 1979 , which proved to be satisfactory . There is
also a possibility that sewerage will be brought into the
area in the near future which shoal& ease the oppositions'
,,o-,-.-y about a v,ater problem.
