A hearing was held on October 281 1957, on the petition of Norman W.
Pitman for a variance of the requirements of the zoning law to allow
the division of his land into two lots and for the erection of a
dwelling on the premises on the southerly side of Willow Street and the
easterly side of Andover By Pass, containing 34802 sq. ft,
This public hearing was advertised in the Lawrence Evening Tribune
on October 16, 1957 and the abutters were duly notified.
The members present and voting on this application were: Donald F.
Smith, Chairman; Henry E. Lund, Daniel O'Leary and Alfred Boeglin,
Associate Member.
There being no objection at the hearing, on February 10, 1958, on
motion duly made and seconded, it was unanimously voted to grant the
variance and to authorize the Building Inspector to issue a permit to the
petitioner in accordance with his petition.
Reasons: The Board finds that the property as now owned by Mr. Pitman
contains 94,530 sq. ft, of land, more or less; that the petitioner
presently has a dwelling on the southerly portion of the lot; that the
northerly section of the lot as it now stands is triangular in shape and
because of the unusual shape of the lot, it is impossible for the petitioner
to so divide the present lot into two lots, each of which would conform with
the requirements of the zoning law.
Therefore, the Board finds that it would be a hardship upon the p6titioner
if he were not allowed to divide some 94,000 sq. ft, into two lots; the
Board further finds that the variance may be granted without derogating from
the intent of the by-law and without cause of injury to the general character
of the neighborhood, The variance is granted in accordance with a plan
annexed hereto and made a part hereof entitled "Preliminary Subdivisioh Plan
of Ladd in N. Andover, Mass. as made for Norman. W. Pitman, Oct. 1957,
Clinton F. Goodwin Reg. Prof. Eng.+' and the Building Inspector is authorized
to issue a building permit in accordance with said plan.
