MAR 12 si PM 183 '�a.+cNus TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS March 25 , 1983 Mr. Daniel Long, Town Clerk Petition No. 13 - '83 Town Office Building Edward Plotkin North Andover, Mass . 1538 Turnpike Street Dear Mr. Long: The Board of Appeals held a public hearing on Monday evening, March 14, 1983 upon the application of Edward Plotkin. The hearing was advertised in the Lawrence Eagle Tribune on Feb- ruary 28 and March 7, 1983 and all abutters were notified by regular mail. The following members were present and voting: Alfred E. Frizelle , Esq. , Vice Chairman; Richard J. Trepanier, Esq. , Clerk; William J. Sullivan; Walter F. Soule; and Maurice Foulds. The petitioner seeks a variance from the provisions of Section 7 , Paragraph 7. 1 and Table 2 of the Zoning By Law to permit the use of land having less than the required lot area on the premises located on the North side of Turnpike Street and known as 1538 Turnpike Street. The petitioner testified, through counsel, that his father was granted a variance for the same parcel by the Board of Appeals on March 8, 1982 , being Petition No. 4 - ' 82 . Because his father was unable to market the property, a building permit was not issued within the twelve month time limitation. Therefore, Mr. Plotkin is re-applying for the same variance. He further testified that he has purchased the parcel from his father and proposes to construct an office building on the site. Upon a motion made by Mr, 'Trepanier, and seconded by Mr. Soule , the Board voted unanimously to grant the request to extend the variance , as requested by the applicant. The location of the lot in question enables this petition to be granted without detriment to the public nor derogate from the intent and purpose of the Zoning By Law. The hearing was advertised in the North Andover Citizen on Jan- uary 21 and 28, 1982 and all abutters were notified by regular mail . The following members were present and voting : Frank Serio , Jr . , Chairman ; Alfred E . Frizelle , Esq . ,' Vice-Chairman ; Richard J . Trepanier , Esq . , Clerk ; Augustine W. Nickerson ; and Walter F. Soule . The petitioner seeks a variance from the provisions of Section 7 , Paragraph 7 . 1 and Table 2 of the Zoning By Law for the premises located on the North side of Turnpike Street known as 1538 Turn- pike Street . Counsel for the petitioner introduced evidence showing that the lot has 43 ,500 square feet of land which was acquired by the petitioner from a member of his family . The lot is located in an Industrial -1 zone , which provides that there be 80 ,000 square feet of land . The petitioner would like to sell the property,, but because of its unique size and shape , is barred unless a variance is granted.
