Lyons, Town Clerk Town Building Nbrth Andover, Mass, Dear Sir: The following petition was heard at a meeting of the Board of Appeals on Monday evening, January 14, 1963 at the Town Office Building. Members present and voting were: Daniel T. OtLeary, Chairman; Robert J. Burke, Secretary; Howard Gilman, William Morton and Associate Me4er Arthur Drummond who sat in place of Henry Lund. Leopold Pomerleau requested a variation of See. 6, Para. 6.33 of the Zoning By-Law so as to permit the subdivision of a lot and to convey to adjoining owners a small triangular parcel and parcel to the rear of adjoining owners to make both lots more symmetrical on the premises, located at south side of Hill- side Road; 165 feet distant from the corner of Salem Turnpike and known as No. 234 Hillside Road.. This public hearing was advertised in the Eagle-Tribune on December 31, 1962 and January 7, 1963. All abutters were duly notified by certified mail of this hearing. There were no abutters present and there was no opposition. Atty. Harold Morley represented the petitioner, who was also Present. The Board discussed and voted on the petition. Mr. Burke made a motion to GRANT the variance, Mr. Morton seconded the motion and the vote was unanimous. This variance is granted for the following reasons: 1. There exist certain conditions, especially affecting the parcel in question, which do not generally affect the entire zoning district in which the parcel is located. 2. Unless the variance is granted, the applicant will suffer substantial hardship, financial or otherwise. 3 The requested variance will not adversely affect the public good to any sub- stantial extent and will not materially affect the general character of the neigh- borhood. 4* The requested variance will not be in substantial derogation fro the intent or purpose of the Zoning By-Law. Drwumords. .Associate: saber Board of Appeals CHILDREN'S FARES - ONE child under five (5) years of age when accompanied by passenger paying a full fare and not occupying a seat to the exclusion of other passengers, will be carried free . Children under five (5) years of age and occupying seats to the exclusion of other passengers - and children five (5) years and under twelve (12) years of age - will be charged one half (1/2) the adult fare as indicated above. RElDEMPTION OF TICKETS - Tickets will be redeemed at our main office, 1980 Broadway Road, Dracut , MA at the fare paid, minus commission paid and service charges, provided application is made within thirty (30) days from date of purchase. No refund will be made on any cancelled tickets or identification stubs. LOST ARTICLES - We cannot be responsible for articles left in coaches or terminals but we will try to recover your property for you. BAGGAGE REGULATIONS - Carrier will not check baggage and assumes no responsibility for any loss thereof. ANIMALS will not be transported in coaches EXCEPT a Seeing Eye Dog accompanying a blind person. ANY PERSON not wearing proper footwear or who is intoxicated, obnoxious, disorderly, or in any way contributes to the unsafe operation of the coach will be refused transportation or will be ejected from. the coach.
