Dear Mr . Long :
The Board of Appeals held a public hearing on Monday evening , De-
cember 10 , 1984 upon the application of Alvan and Jennie Poutenis .
The hearing was advertised in the North Andover Citizen on November
21 and 29 , 1984 and all abutters were notified by regular mail . The
following members were present and voting : Frank Serio , Jr . , Chair-
man; Richard J . Trepanier , Esq . , Clerk ; William J . Sullivan ; and
Associate Members Walter F . Soule and Maurice S . Foulds .
The petitioners seek a Special Permit under Section 4 . 122 , Paragraph
14 of the Zoning By Law so as to permit the conversion of a three-
family dwelling to a four-family dwelling on premises located at
160-162 Waverly Road in the Residential -4 (R-4) zoning district .
Counsel for the petitioners testified that the Board of Appeals
granted a Special Permit in August of 1982 to convert the then
existing duplex from a two-family dwelling to a three-family unit .
At that time , the third unit was made on the first floor . The
petitioners reconstructed the parking area on Morris Street to
accommodate the third unit and the same parking area can accommodate
the proposed fourth unit . They are now requesting that the second
floor be renovated the same as the first floor , resulting in the
four-family dwelling . The only exterior change will be the addition
of an enclosed staircase .
He further testified that there are other multi;-family dwellings in
the neighborhood.

Upon a motion made by Mr . Soule and seconded by Mr . Trepanier , the
Board voted unanimously to grant the Special Permit as requested.
In granting the Special Permit , the Board finds that Section 10 . 31
of ,the Zoning By Law has been satisfied. In particular , the Board
finds that the specific site , being a neighborhood consisting of
multi -family dwellings and scattered small businesses, is an appro-
priate location for such a structure ; the use as developed will not
adversely affect the neighborhood , since the neighborhood is an
older , established , multi -family one ; there will be no nuisance or
serious hazard to vehicles or pedestrians, since adequate off-street
parking will be provided off Morris Street for the added unit; and
adequate and appropriate facilities of water and sewer service are
available .
The Board further finds that the use is in harmony with the general
purpose and intent of the Zoning By Law.

The Board of Appeals held a public hearing on Monday evening ,
July 12 , 1982 upon the application of Alvin and Jennie Poutenis .
At the petitioner ' s request , the hearing was continued until
Monday evening, August 9 , 1982 with the following members present
and voting; Frank Serio , Jr. , Chairman ; Alfred E . Frizelle , Esq . ,
Vice Chairman ; Richard J .' Trepanier , Esq . , Clerk, William J .
Sullivan . and Augustine W . Nickerson . The hearing was advertised
in the North Andover Citizen on June 24 and July 1 , 1982 and
all abutters were notified by regular mail ,
The petitioner seeks a Special Permit under Section 4 . 122 , Para-
graph 14 of the Zoning By Law so as to permit the conversion of
a two-family dwelling to a three-family dwelling on the premises
located at 160-162 Waverly Road,
The petitioner testified , through counsel , that the neighborhood
is comprised of a mixture of commercial and multi -family dwellings .
He proposed that parking be provided on Morris Street .
No one spoke in opposition to the petition .
Upon a motion made by Mr . Frizelle and seconded by Mr, Trepanier,
the Board voted unanimously to grant the Special Permit as re-
quested with the condition that the parking lot as shown on the
plan be paved prior to the issuance of the builidng permit for the
conversion . '

three-family unit and that each of the provisions of Sectton 10 ,
Paragraph 10. 31 of the Zoning By Law for a Special Permit have
been satisfied .
