North Andover , Mass . Petition No . 69-,183
Dear Mr . Long :
The Board of Appeals held a public hearing on Monday evening ,
November 14 , 1983 upon the application of Prescott Village
Development Corporation . The hearing was advertised in the
North Andover Citizen on October 27 and November 3 , 1983 and
all abutters were notified by regular mail . The following
members were present and voting . Frank Serio , Jr . , Chairman ;
Richard J . Trepanier , Esq . , Clerk ; William J . Sullivan ; and
Associate Members Walter F. Soule and Raymond A . Vivenzio .
The petitioner seeks a variance from the provisions of Section
7, Paragraph. 7 . 3 and Table 2 of the Zoning By Law to permit re -
lief from the side setback requirement to allow the continued
existence of a dwelling (townhouse ) which does not meet the
setback requirement of the Zoning By Law on premises located
at Lot 1 Stacy Drive .
The petitioner testified through counsel that the dwelling ( unit)
was constructed in the spring of 1983 and when an "As Built " plan
was required the setback violation was discovered .
Upon a motion made by Mr . Soule and seconded by Mr . Vivenzio , the
Board voted four to one to grant the variance as requested .
The Board finds that Section 10 . 4 of the Zoning By Law has been
satisfied . Specifically , the Board finds that due to the location
of the townhouse unit on the premises with its slight deviation
from the requirements of the Zoning By Law constitutes a hardship
to the petitioner . Said variance , in the opinion of the Board , may
be granted without nullifying or substantially derogating from the
intent and purpose of the By Law.
