Dear Sirs
The following petition was heard at a meeting of the Board of Appeals on Monday
evening, November 8, 1965 at the Town Office Building. Members present and voting
were; Daniel T. O'Leary, Chairman; William Morton, Secretary; Arthur Drummond,
John .J. ' Shields and James Deyo.
DORIS & WALTER PtK:STOSZ requested a variation of See. 6.33 of the Zoning By Law
so as to permit the variation of the lot area and street frontage requirements
to obtain two lots, one to contain 7,200 sq. ft. and one to contain 12,000 sq.
ft. , out of eleven lots, on the premises, located at the north side of Camden
Street;1100 feet distant from the corner of Concord St. at Camden & Lexington
Streets
This public hearing was advertised in the Eagle Tribune on October 25 and
November 1, 1965. All abutters were duly notified by certified mail of this
hearing. Atty. John J. Willis represented the petitioners, who were also present.
He explained that this plan of small lots was created in 1909, known as Colonial
Gardens. Lots were 25x80 and purchased in 1922 by Mrs. Annie Kasheta, now de-
ceased, which affected a transfer into joint names. They desire to build on
Lot B which contains 12,000 sq. ft. and would face house on Lexington Street.
Mrs. Prestosz is the granddaughter of Mrs. Ea.sheta and now owns the land as of
January, 1965 through inheritance. There were ten abutters present and just
asked questions. There was no opposition.
In Executive session, after thorough discussion, Mr. Shields made a motion to
GRANT the variap_ee. Mr. Morton seconded the motion and the vote was unanimous.
The Board voted to grant the variance for the following reasons.
a. The proposed lots would not be in derogation to the neighborhood.
b. There exist certain conditions, especially affecting the parcel in question,
which do not generally affect the entire zoning district in which the parcel is
located.

C. The Board sees no derogation to abutting properties or to existing neighbor-
hood influences.
d. To deny the said petition would result in a substantial hardship, financial or
otherwise; the best end-use of the land would be denied and the town as well as the
applicant would suffer hardship.
e. to observable zoning non-conformity would appear to any passerby, nor to any
adjacent landowner.
f. The lot sizes are not in non-conformity with the typical influences of the
neighbolhood.
