Re: Richard and Danielle Ratte Special Permit - Watershed
Dear Mr. Long:
The North Andover Planning Board held a public hearing on Mon -
day evening, July 19, 1982 in the Town Office Meeting Room upon
the application of Richard and Danielle Ratte. The hearing was
!advertised in the North Andover Citizen on July 1 and 8, 1982,
and all abutters were notified by certified mail. The following
members were present and voting: Paul A. Hedstrom, Esq„ Chairman;
Michael P. Roberts, Vice Chairman; John J. Burke; and Erich W.
Nitzsche.
The petitioner seeks a Special Permit under Section 4,133, Para -
graph 3(d) of the Zoning By Law so as to permit the construction
of a single family dwelling located within eighty -five (85) feet
of a tributary to Lake Cochichewick on a lot of land located
within the Watershed District, on the premises located on the
North side of Great Pond' Road and known as Lot 7, Great Pond Road.
Mr. and Mrs. Ratte testified, through counsel, that the proposed
dwelling will be located two hundred and seventy (270) feet from
Lake Cochichewick. The northeast corner of the dwelling will be
eighty -five - (85) feet from the lake's tributary.
Mr. Daiige, the engineer, determined the optimum dwelling loca-
tion to land topography to be that designed on the plan dated
July 13, 1982. The septic - system plan and location has been approved
by the Board of Health and satisfies the regulations of D.E.Q.E.
file #242 -254, whereby no impurities shall flow toward the tribu-
tary and lake.
The granting of said Special Permit will in no way derogate from
the intent and purpose of the North Andover Zoning By Laws.

The site affected is located in the R -2 zoning district, possessing
an area of 1.24 acres with 150 feet of frontage. The proposed
dwelling will have the following dimensions, 68'4" front; 55'8"
deep; Height: 1 story; 18'.
Upon a motion made by Mr. Roberts and seconded by Mr. Burke, the
Board voted unanimously to grant the Special Permit subject to
the following conditions;
1. That "As Built" grading plans prepared by a certified pro -
fessional engineer be submitted to the Planning Board for
approval before a Certificate of Use and Occupancy is issued.
2. A Certificate of Compliance shall be obtained from the Con-
servation Commission.
In granting the Special Permit, the Board finds, pursuant to
Section 10.31 of the Zoning By Law, that:
a) The specific site is an appropriate location for such a
structure;
b) The use as developed will not adversely affect the neigh -
borhood;
c) There will be no nuisance or serious hazard to vehicles
or pedestrians;
d) Adequate and appropriate faciliteis will be provided for
the proper operation of the proposed use; and,
e) The use is in harmony with the general purpose and intent
of the Zoning By Law.

Owner desires a special permit to allow for construction within eighty -five (85)

The septic system designed by Alfred A. Shaboo, P. E., is in the possession of the
Board .of Health, and I have satisfied the regulations of the D. E. Q. E.,
File 14242 -154.

Every application for action by the Board shall be made on a form approved by the
Board. These forms shall be furnished by the Clerk • upon request. Any communication -
purporting to be an application shall be treated as mere notice of intention to_:seek
relief until such time as it is made on the official application form. All information
called for by the form shall be furnished by the applicant in the manner therein
prescribed.
Every application shall be submitted with a list of "Parties in Interest" which
shall include the petitioner, abutters, owners of land directly opposite on any public
or private street or way and abutters to the abutters within three hundred, (300) feet
of the property line all as they on the most recent applicable tax list, notwith-
standing that the land of any such owner is located in another city or town, the Plan-
ning Board of the town and the planning board of every abutting city or town.
