The Board of Appeals held a public hearing on the application of Kenneth W. Rea
on Tuesday evening, June 13, 1989, requesting a variance from the requirements
of Section 5 of the Zoning Bylaw so as to permit renewal of earth removal permit
originally granted in August of 1963, which has been renewed and used continually
since that date. The following members were present and voting: Frank Serio, Jr.
Chairman, Raymond Vivenzio, Acting Clerk, Walter Soule, Anna O'Connor and Louis
Rissin.
The hearing was advertised in the North Andover Citizen on May 11 and May 18, 1989
and all abutters were notified by regular mail.
Upon a motion made by Ms. O'Connor and seconded by Mr. Vivenzio the Board voted,
unanimously, to GRANT the variance as requested.
The Board finds that the petitioner has satisfied the provisions of Section 10,
Paragraph 10.4 of the Zoning Bylaws and that granting this variance will not
adversely affect the neighborhood nor derogate from the intent and purpose of
the Zoning ByLaw.

The Board of Appeals held a public hearing on Tuesday evening, June 12, 1990
upon the application of Kenmeth Rea requesting a Special Permit from the
requirements of Section 5, Earth Removal, of the Zoning Bylaw on the premises
loc4ted at 44 Rea Street and the east side of Chestnut Street. This permit
was originally issued in 1963 for gravel removal and has been renewed each
year since. The following members were present and voting: Frank Serio, Jr.
Chairman, William Sullivan, Vice-chairman, Walter Soule, Raymond Vivenzio,
and Anna O'Connor.
The hearing was advertised in the North Andover Citizen on May 9, 1990 and
May 16, 1990 and all abutters were notified by regular mail
Upon a motion made by Mr. Sullivan and seconded by Mr. Soule, the Board
voted, unanimously, to GRANT this Special Permit as requested.
The Board finds that the petitioner has satisfied the provisions of Section
10, Paragraph 10.3 of the Zoning Bylaws and that the granting of this Special
Permit will not adversely affect the neighborhood nor derogate from the intent
and purposes of the Zoning ByLaw.

The Board of Appeals held a public hearing on Tuesday evening,
June ii, 1991 upon the application of Kenneth W. Rea requesting
a Special permit from the requirements of Section S, Earth
Removal, of the zoning By-Law on the premises located at 44 Rea
Street and the east side of Chestnut Street. This permit was
originally issued in 1983 for gravel removal and has been
renewed each year since. The following members were present and
votingi f=rank Serio, Jr. , Chairman; William Sullivan, Vice-
Chairman; Walter Soule, Raymond Vivenzio and Anna O' Connor.
The hearing was advertised in the North Andover Citizen on
May 22 and 29, 1991 and all abutters were notified by regular
mail.
Upon a motion made by Mr. Sullivan and seconded by Mrs.
O" Connor, the Board voted, unanimously, to GRANT this Special
Permit as requested.
The Board finds that the petitioner has satisfied the provisions
of Section 105 paragraph 10. 3 of the Zoning By-Law and that the
granting of this Special permit will not adversely affect the
neighborhood nor derogate from the intent and purpose of the
Zoning By-Law.
