Dear Sir:
A meeting of the Board of Appeals was held on July 131 1959
at 7 :1.5 PlM at the Town Building on the application of Arthur
Redmond requesting a Special Permit of Section 61 Paragraph 6.2
of the zoning By Law so as to permit the tranECer of Lot 271
to Frank Driscoll on the premises lobated at the 'Nesterly side
of Dartiouth Street, 100 feet distance from the corner of Turnpike
Street. Aiembers present and voting were: Daniel T. O'Leary, Chair-
man, eYlry �". Lund, Robert Burke, Howard Gilman and Harold Morley
Jr. A-sociate Member.
Mr. O'Leary read a letter from the Board of Health dated June 2, 1959
statinG it was very important from a health view point in so far
as it :could permit Mr. Driscoll to install a suitable adequate sub-
surface disposal system. This is impossible on Mr. Driscoll' s lot
size. 1.1r. Redmond will also have enough land to maintain an adequate
sy ster.
The 3oard of Health recommends this variance be granted as in so doing
a possible health hazard can be prevented. The letter was signed by
Mary 2. S'neridan, Agent.
A Motiol was duly made and seconded and it was unanimously voted that
this s--)ecial permit be granted.

The petition of Artnur L. Redmond, 229 Washington Street, Heading,
Massachusetts for a variance of Section 7, Paragraph 7.22 of the
Zoning By-Law so as to allow a variance of tie set back and/or side
line requirements for three dwellings A, B , C on a plan of land of
Arthur L. Aedmond, North Andover, July 1958) nalph Brassetar, G•�E-
came on to be heard on August 119 1958• Present and voting were
Daniel O'Leary, Chairman, Kenneth 1erroua, Secretary, Hobert Burke,
Donald Smith and Alfred boeglin, Associate Member.
The Petitioner appeared for himself.
The board finds that the land is located on the Northeast side of
ootuit Street and on the Southeast side of Ipswich Street. Three
hoases have 'been eonstxuoted and have been completed, one of each
on lots A$:b9C and :).
The Board finds that all of the buildings are located at least 21 feet
from all lot lines. The board further finds, ho,Mever, that the build-
ings do not meet the set back requirements of 30 feet.
The Board finds that the buildings were constructed in accordance with
building permits issued by the wilding Inspector but that because of
an error in locating the foundation all
ho sestfailed to meet the re-
quirements of the set back line by varying
Upon motion duly made and samnded, it was voted that Section 7 , Para-
&�aph 7 .22 of the Zoning By-Law be varpLed wits_ respect to all three
buildings.
iteasons for the decision because of the fact that the three houses are
now 'eompleted and because it appears that the Petitioner has made an
error with respect to distances of the street line, and because the
Variance required would be slight and can be ;granted without substantially
derrogating from the intent and purpose of the By-Law, the Board has
voted to YA,tz the requirements of the By-Law.
