JAN 18 1149 AN '83 BACIWSl� TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS January 24 , 1983 Carole Resca 313-315 Sutton Street Petition No. 43-182 Mr. Daniel Long, Town Clerk Town Office Building North Andover, Mass. 01845 Dear Mr. Long: The Board of Appeals held a public hearing on Monday evening, December 13, 1982 upon the application of Carole Resca. The hearing was advertised in the North Andover Citizen on November 24 and December 2 , 1982 and all abutters were notified by regular mail. The following members were present and voting: Alfred E. Frizelle , Esq. , Vice Chairman' Richard J. Trepanier, Esq. , Clerk; William J. Sullivan; Augustine W. Nickerson; and Maurice S. Foulds . The petitioner seeks a Special Permit under Section 4 , Par. 4. 122 (14C) and a variance under Section 4 , Par. 4. 122 (14) of the Zoning By Law to permit the conversion of a four family dwelling to a five family dwelling on the premises located at 313-315 Sutton St. The petitioner testified through counsel that the dwelling was con- structed on the premises many years ago and that it is economically necessary to convert the existing four family dwelling to a five family dwelling and that the variance is necessary because of the dwelling's non-conformance . The petitioner proposed that parking be provided on the side of the dwelling. The Office of Community Development supported the application; how- ever, some abutters voiced their opposition to the proposed added unit. The Board finds that Section 10 . 4 of the Zoning By Law has not been satisfied. Specifically, the Board finds that the specific site is not an appropriate location for such a use due to the fact that the premises are located at a heavily travelled, dangerous intersection; the use, as developed, will have an adverse affect on the neighborhood due to increased traffic; and that the use is not in harmony with the general purpose and intent of the Zoning By Law.
