Dear Mr. Long:
The ]bard of Appeals held a public hearing on Tuesday evening,
June 14, 1983 upon the application of Roger Richard. The hearing
was advertised in the North Andover Citizen on May 26 and June 2,
1983 and all abutters were notified by regular mail. The follow-
ing members were present and voting: Frank Serio, Jr. , Chairman; -
Alfred E. Frizelle, Esq. , Vice Chairman; William J. Sullivan;
Augustine W. Nickerson; and Maurice S. Foulds .
The petitioner seeks a variance from the provisions of Section 7,
Paragraph 7. 3 and Table 2 of the Zoning By Law to permit relief
from the rear setback requirement to allow the construction of a
deck which will not meet the rear setback requirements on premises
located on the East side of Carlton Lane and known as Lot 26D,
Carlton Lane .
The petitioner testified through his engineer that the dwelling is
not completed and that the petitioner would like to construct a
12 ' x 24 ' open deck on the rear of the dwelling, which would not
satisfy the rear setback requirement of 30 feet. The sliding doors
to the proposed deck are already placed in the dwelling.
Upon a motion made by Mr. Frizelle and seconded by Mr. Sullivan, the
Board voted four to one , with member Sullivan in opposition, to grant
the variance as requested for an open deck only.
The Board finds that a literal enforcement of the Zoning By Law would
create a hardship to the petitioner and that the variance can be granted
without detriment to the public good and without nulliying or dero-
gating from the intent and purpose of the Zoning By Law.
