Dear Sip:
The following petition was heard at a !meeting of the Board of Appeals on Monday ev+sning.. 4
December 14, 1964 at the Town Office Building. Members present and voting were:
Daniel T. OtLeary, Chairman; William Mrton, Secretary; Henry S. Lund, Arthur Drummond
and Johne'. Shields.
AINTOZNE ROBERGE requested a variation of Sec. 6, Para. 6.3 of the Zoning By-Law so as to
permit the subdivision of a parcel of land into three lots on the premises, located at
the south side of Greene Street; 150 feet distant from the corner of Linden Avenue and'
known as #254 Greene Street.
This public hearing was advertised in the Nagle Tribune on November 23 & 30, 1964. All
abutters were duly notified by certified mail of this bearing.
The petitioner was represented by Atty. John J. Willis. In presenting the petition,
the plan showing the land of Antoine Roberge bounded by Greene Street and Great Oak Ave.,
North Andover, together with the proposed sub-division of lots A, B & G', Atty, Willis
indicated and it`was verifted that this area was originally sub-divided prior to the
adoption of the Zoning Bylaws into typical lots of 50 ft. frontage:,.and typical sizes
of 5,000 sq. ft.
That it has been -owned by Antoine,Roberge, who now wants to take advantage of the pro-
visions contained in See. 6.62 of the Zoning By-Laws which allow permissive use by the
Board of Appeals to permit the joining of two or more vacant lots into a new lot of
not less than 100 ft. street frontage and containing not less than 10,000 sq. ft in size.
Atty. Willis indicated the condition of lot C, which is bounded by Great Oak Ave. and
Greene Street and contains 22,755 sq. ft. with an existing dwelling thereon. Atty. Willis
further illustrated that lot A as proposed, would have only a 90 ft. street frontage
bounded by Greene Street but would contain 11,169 sg. ft. The reason for this type of
planning is in order to maintain a required side line set-back for the existing property
now on lot C. There were no other comments from any one speaking for the petitioner.

There were no vd4ed objections to the adoption or granting of the petition.
There were two other neighbors who inquired as to the intentions and desired to see the
plan, which was extended to them and after examining them stated there were no objections.

The petition was taken under advisement.
In considering the petition, the Board reviewed the plan and found that proposed lot B
conformed with the intent and purpose of the provisions of Para. 6.62.
In considering the proposed lot A, the Board finds that 90 ft. frontage is inconsistent
with the permission of the provisions of Sec. 6.62 but from a practical, economic and
land planning approach, it was considered that lot A as presented offers the best
engineering approach to good land planning coupled with the maintenance of side lot
line requirements on lot 0. r
That there are many lots in the general area of approximately the same size, of less
size, and that it would not be untypical of many lots in the general neighborhood.
Were the requested variance to be granted and a conformibg dwelling to be constructed
upon the parcel, lot A, no observable zoning non—conformity would appear to any passer—
by nor to the adjacent land owner.
That a denial of this petition would in effect be an unreasonable end use of the
petitioner's land and consequently cause a hardship.
Motion was wide by John J. Shields, seconded by Arthur Drummond that the petition be
GRANTED. The vote was unanimous.
