Dear Sirs
The following petition was heard at a meeting of the Board of Appeals an
Monday evening, August 9, 1965 at the Town Office Building. Members present and
voting weret Daniel T. OtLeary, Chairman; William Morton, Secretary; Arthur prvmmond,
James Deyo and Associate Member Robert J. Burke who sat in place of regular member
John J. Shields.
ERNEST J. & BERTHA ROBMS requested a variation of Sec. 6.31 of the Zoning By-Laws
so as to permit the subdivision of three 50400 ft. lots into two 75400 ft. lots
on the premises, located at the southeasterly side of Irving Road and known as #22
Irving Road.
This public hearing was advertised in the Eagle Tribune on July 26 and August 2, 1965.
All abutters were duly notified by certified mail of this hearing. Atty. Ralph S,
Finck represented the petitioners, who were also present. They desire to combine
three 50x100 ft. lots into two 75x100 ft. lots and that the size of these lots would
be in keeping with the general area since there are many lots of this aim there now.
The petitioner is looking to the future in order to have land available when his
children may want to build a home. There were six people present. One abutter was
recorded as opposed because his lot is 100x100 sq. ft. and doesn't see why the
petitioner should be allowed to have his lots smaller. One person, was not opposed but
questioned whether the property would be sold outside of the family.
In Eoecutive session, an analysis was made with respect to the typical lot sizes
influencing the neighborhood and it was found that the lots proposed were not in-
consistent in size of most of the lots in the immediate area.
Mr. Burke made a motion to GRANT the variance, which was seconded by Mr. Deyo and
voted unanimously.
The Board voted unanimously to grant the petition for the following reasonst
a. That the proposed lots would not be in derogation to the neighborhood.
b. That the lot sizes were not in non-conformity with the typical influences of the
neighborhood.

c. To deny said petition would result in a substantial hardship, financial or
otherwise, to the petitioner.
d. That the proposed sub-division will be the highest and best land planning for
end use.
