Dear Sir:
This petition was heard at a meeting of the Board of Appeals on Monday evening,
Juwe 19, 1961 at the Town Office Building. Members present and voting were:
Daniel T. O'Leary, Chairman; Charles Foster, Secretary; Howard L. Gilman,
Associate Member Harold Morley, Jr., and Associate Member Alfred Bosglin.
The Chairman designated Mr. Morley to sit in place of Mr. Burke and Mr.
Boeglin in place of Mr. bund.
Walter V. Demers and John J. Shea, requested a Special Permit for an apartment
development under Fara. 4.7 of the Zoning Bar-Law so as to permit the con-
struction of five garden-type apartment structures, each containing not more
than twelve dwelling units, on the premises, located at the West Side of
Chickering Road, rear of Lund Garden Center.
Mr. Shea represented himself sad explained the need for apartments in Tonal and
also pointed out that this development would bring cons3ideraUe tax revenue to
the Town. Mr. Phelan of the gown Industrial Committee added this would be a
great asset to the Town. Mr. Olenio and Mr. Lund were also in favor.
Mrs. Elaine Griffin, 841 Chickering Rd. and Mr. Harry Mellian, President &
Treasurer of the Motel Corp. objected violently and voiced great opposition to
this Special Permit.
Mr. Boeglin made a miction to accept the plans subject to the approval of the
Plamning Board. Mr. Gilman seconded the notion and the vote was unanimous.
The Board of Appeals finds that the development as planned will not be detri-
mental to the neighborhood in which it is located, and that the Tom can
reasonably provide the proposed development with all necessary utilities and
facilities.
At sa special meeting held on Wednesday evening, July 5, 1961, the above members
voted unanimously that after a report from the Planning Board, the plan sub-
mitted is APPROVED subject to the following;

I. Two hydrants instead of one; the second hydrant to be located on the south-
westerly side of Building #1.
2. The 68 water main should be not less than 8e.
3. all travelways should be Bitusi.nous Ooncrete instead of oil penetration
as shown on the plats, to a depth suitable to the Highway Department.
4. The Petitioner meet file a suitable Bond to comply with the Highww Dept.
and the Board of Public Works, the amount of said Bonds to be set by the
Highway Dept. and the Board of Public Works.
5. All building shalt conform to Para. 4.73•
