Dear Sir:
A public hearing was held by the Board of Appeals on June 14, 1971 upon application
of ANNA CARON and SALVATORE LaROSA who requested a variation of Sec. 6.31 & 7.23 of
the Zoning By—Law so as to permit the division of a lot of land into two parcelsl
both having less than the required area and frontage, and the erection of a dwelling
on the newly formed lot nearer the rear lot line than the required 30 feet; on the
premises located at the west side of Lexington Street; at the corner of Concord Street
and known as 24 Lexington Street. The following members were present and voting:
J. Philip Arsenault, Esq., Chairman; Dr. Eugene A. Beliveau, Clerk; Kenneth E.
Pickard, Vice Chairman; Arthur R. Drummond and Frank Serio, Jr.
The hearing was advertised in the Lawrence Eagle—Tribune on May 29 and June 57 1971
and all abutters were duly notified by regular mail.
Mrs. Garon and Mr. LaRosa appeared on their own behalf and explained their request
for the variance. Mrs. Garon said he husband died and she is alone and would like
to give a lot of land to her daughter and son—in—law so that they would be nearby
and could help her out taking care of the property, etc. Mr. LaRosa explained he
is asking for a setback variance, area and frontage. He said it would be a hardship
if the variance was not granted. Sewer facilities are available. Mr. McAuliffe -and
Mr. Martin, immediate abutters, said they had no objections to the requested variance.
Dr. Ceplikas, was opposed in behalf of his mother who is also an abutter. He said
it would be too great a deviation from the Zoning By—Law and it would create a
traffic hazard.
The petition was taken under advisement and during this period was reviewed by the
Board. Mr. Drummond made a motion to DENY the variance; Mr. Serio seconded the
motion and the vote was unanimous. The Board felt that to grant a lot with an area
of 5,040 feet in a Village Residence district where 12,500 sq. ft. are required
would be in substantial derogation of the Zoning By—Law.

Dear Sirs
Upon application of James Garon to the North Andover Board of Appeals for a
variance under Section 6.31 and 7.23 so as to permit the division of an existing
lot into two parcels, a public }wring was held on April 152 1968 by the North
Andover Board of Appeals. The hearing was held in the Torn Ball facilities after
having been advertised in the Lawrence Eagle-Tribune on the dates March 30 and
April 62 1968 and with all abutters duly notified by certified mail* The members of
the Board present and voting weres dames A. Deyo, Chairman; Arthur Dr amond,
Secretax7; Daniel T. OtLeaxy, Donald J. Scott and John J. Shields.
The petitioner represented himself and stated his ease by pleading that it was his
desire to split his lot into two parts so as to create a lot upon which his
prospective son-in-law could build a house. He stated that he realised the lots
were smaller than permitted but that there were many in existence approximately the
same size as those he proposed. He stated that the house to be 'built on the pro-
posed lot would be a credit to the neighborhood and would be an asset to the town.
There were several persons present at the hearing with some registering opposition
to the small size of the proposed lot and also to the added traffic on the street.
There were others present who were not too concerned over the proposal but did not
speak either in favor or against the petition.
A motion was made., seconded and passed that the petition be taken under advisement.
During this period the Board moved to view the area prior to making a decision on
the petition. At a later date, June 10, 1968, the Board took up this petition
having viewed the area and examined Assessorts maps of the lots in the area and
reached a decision. A motion was made by Mr. Shields, seconded by Mr. Scott to
Decay the petition. Four members voted for the denial. and Mr. OlLeary voted against
denying the petition

1. Granting the variance would have been a severe deviation from the intent and
purpose of the Zoning Byr-kava.
