Dear Sir: Upon application of Ernest and Nancy Gauthier to the North Andover Board of Appeals requ4sting a variation of Section x.19 of the Zoning By-Laws so as to permit a kennel for the keeping of dogs, a public hearing was held on June 109 1968 by the North Andover Board of Appeals. The hearing was held in the Town Ball facilities after having been advertised in the Lawrence Eagle-Tribune on the dates May 25 and June 10 1968 and with all abutters duly notified by certified mail. The members of the Board present and voting were; James A, Deyo Chairman; Arthur , Secretary; Daniel T. O'Leary., Donald J. Scott, and iobn J. Shields. Attorney Charles V. Trombly appeared for the petitioners. The argmsents for the petition were that the petitioners had purchased the tract of land a few months prior with the intention of realizing a long standing akbition, that of keeping a kennel for dogs. They would accept and conform to whatever conditions the Board might i*ooe in granting the petition. They fully intended to design and build the kennel with the idea of minimizing possible noise. The kennel would be strictly a Rboardi.ne and possible •training° with no hospital tendencies. The dogs would be inside at-all times during the night. Several persons spoke in opposition to the petition stating as principal reason the probable excess noise from the dogs. After a brief rebuttal and other questions directed by the Board, a notion was made and passed that the petition be taken under advisement. Datong this period a review of the petition brought out that the request was for a very substantial deviation from the Bye-Laws. Gautbier -2— dime A 1968 A motion was made by Mr. O'Leary and seconded by Mr. Shields that the petition be denied. The motion carried unanimously.
