Dear Mr, Long: A public hearing was held by the Board of Appeals on March 12, 1979 upon application of anile A. and Antoinette Giard who requested a variation of Sec. 6.2 and Table 2 of the Zoning By—Law so as to permit a division of land into two (2) parcels to allow construction of a dwelling on one (1) parcel located at 130 Appleton St, and shown on a plan of land dated 2/27/79 and revised 4/11/79. The following members were present and voting: Frank Serio, Jr., Chairman; R. Louis DiFruseio, Clerk; James D. Noble, Jr.; Richard J. Trepanier; and Assoc. Member, William J. Sullivan. The hearing was advertised in the North Andover Citizen on Feb. 22 & Mar. 1, 1979 and all abutters were duly notified by regular- mail. At the hearing, the petitioner showed that he owns the premises on Appleton St. having an area of 3.92 acres and street frontage of 230 ft. The petitioner seeks to divide the property into 2 parcels having sufficient area; however, one parcel would not have sufficient frontage. Three abutters were represented by Atty. Dom Scalise at the hearing and stated that they were not opposed to granting the variance, however, they had objections regarding the appearance of the property. The Board subsequently viewed the premises and is of the opinion that the request for conditions regarding appearance of the property should not be imposed in granting the variance. A motion made by Mr. Trepanier and seconded by Mr. DiFrusoio on April 9, 1979 to GRANT the variance was voted unanimously by members DiFruscio, Noble, Trepanier and Sullivan. EMILE A. GL4.RD DECISION _ In granting the variance the Board finds that the unusual shape of the property creates a financial hardship to the petitioner in that it would prevent him from properly using his land. Further, the Board finds that the premises has more than the required area and that the variance will not nullify nor substantially derogate from the intent and purpose of the By—Lax nor will it be against the ublic good or P a detriment to the zoning district since other parcels in the immediate area have less than the required frontage.
