North Andover, MA 01845 * DECISION
The Board of Appeals held a regular meeting on Tuesday evening, October 10, 1989
upon the application of Stephen F. & Nancy M. Salois requesting a variation from
the requirements of Section 7, Paragraph 7.3 and Table 2 of the Zoning Bylaw so
as to permit relief from requirements of side and rear setbacks for an above-
ground pool which has been on the premises for approximately nine (9) years at
17 Highland View Avenue. The following members were present and voting: William
Sullivan, Acting Chairman, Walter Soule, Anna O'Connor and Louis Rissin.
The hearing was advertised in the North Andover Citizen on September 7, 1989 and
September 14, 1989 and all abutters were notified by regular mail
Upon a motion made by Mr. Soule and seconded by Mr. Rissin, the Board voted,
unanimously, to GRANT the variance as requested, subject to the following conditions:
1. All safety and building codes be met.
2. Variance pertains only to the existing above-ground pool, and
the same shall not be reconstructed.
3. Area to be enclosed by a fence approved by the Building
Inspector.
4. A Building Permit and Occupancy Permit must be obtained
from the Building Inspector.
The Board finds that the granting of this variance will not be a detriment to
the community and will not nullify or substantially derogate from the intent and
purpose of this bylaw.
