Lyons, Town Clerk Amodio San Antonio Town Office Building Hewitt Ave. — Petition #21—'73 North Andover, Mass. Dear Sir: A public hearing was held by the Board of Appeals on August 139 1973 upon application of Amedio and Elsie San Antonio, who requested a variation of Section 6.1 of the Zoning By--Law so as to permit the division of an existing parcel of land into three building lots; none of them having the required square footage, and one lot not having the required frontage; located at the north side of Hewitt Ave., approx. 17.5 feet from the corner of Minute Avenue. The following members were present and voting: Frank Serio, Jr., Chairman; Dr, Eugene A. Beliveau, Clerk; William N. Salemme, Louis DiFruscio and Associate Member Alfred E. Frizelle, Esq., who sat in place of regular member Arthur R. Drummond. The hearing was advertised in the Lawrence Eagle—Tribune on July 28 and August 4, 1973; and all abutters were duly notified by regular mail. Atty. Thomas Burke represented the petitioners and explained that they would like to subdivide a parcel of land into three lots; one lot with an existing dwelling containing 10,000 sq. ft. with 100 feet frontage on Hewitt Ave. and Minute Ave. and two lots each containing 12,500 sq. ft. and 125 ft. frontage on Hewitt Ave. In the, immediate area, most of the lots are not even 100000 sq. ft. The peti— tioner does not intend to sell the lots, but wants them for his children to build on in the future. Sewer is available. This property was purchased in 1915 & 1917. He feels that the property should be used to its highest and best use; and that the formation of these lots would increase the tax base of the town. 25,000 sq. ft. lots are required for this R-3 area. William Sullivan, an abutter on Hewitt Ave., was opposed because he said there is a water problem in the area and the construction of new homes would make the water problem worse. The Board took the matter under advisement and will view the area. At a meeting held on September 10, 1973, the Board further discussed the petition and found there was no hardship. Atty. Frizelle made a motion to DENY the petition on the basis of the failure of the petitioner to show substantial hardship; Mr. Salome seconded the motion and the vote was 4 — 1, Mr. DiFruscio voted no. The Board found that the area is zoned R-3, which requireca 259000 sq. ft. lots and that the formation of two lots of 25,000 sq. ft. and one lot of 10,000 sq. ft. was too great SAN ANTONIO -2- September 14, 1913 a deviation from the requirements of the Zoning By-Law; also that there would be no hardship to the petitioner, financial or otherwise. However, the Board would not be adverse to the formation of one building lot.
