Dear Mr. Long:
The Board of Appeals held a public hearing on Monday evening,
April 9 , 1984 upon the application of Elise San Antonio. The
hearing was advertised in the North Andover Citizen on March 22
and 29 , 1984 and all abutters were notified by regular mail. The
following members were present and voting: Frank Serio, Jr. ,
Chairman; Alfred E. Frizelle , Esq. , Vice Chairman; Richard J.
Trepanier, Esq. , Clerk; Augustine W. Nickerson; and Walter F.
Soule.
The petitioner seeks a variance from the provisions of Section 7 ,
Paragraph 7. 1 and Table 2 of the Zoning By Law so as to permit
relief from the lot area requirement to allow the subdivision of
a parcel of land into two parcels , each having less than the
minimum lot area requirement, on premises located in the Residential-3
(R-3) zoning district located at 30 Hewitt Avenue.
Evidence presented by the petitioner's attorney revealed that the
petitioner resides at 30 Hewitt Avenue and wishes to divide her
land and sell a 12 ,500 square foot lot for retirement income. The
neighborhood consists of several similarly sized and smaller lots .
Denial of the variance would create a financial hardship to the
petitioner, since it would render the open lot useless under the
current Zoning By Law.
Upon a motion made by Mr. Trepanier and seconded by Mr. Soule, the
Board voted 4 to 1, with Member Frizelle voting in opposition, to
grant the variance as requested with the condition that the plan be
revised to show the applicant' s correct name and the correct name
of the street.

In granting the variance, the Board finds that Section 10 . 4 of the
Zoning By Law has been satisfied. In particular, the Board finds
that a literal enforcement of the provisions of the By Law would
create a financial hardship to the petitioner and that desirable
relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the
intent and purpose of the Zoning By Law.
