Town Office Building North Andover, Na. Dear Mr. bong: A public hearing was held by the Board of Appeals on July 14, 1980 upon application of Robert W. Savage requesting a variance of Sec. 7.1, 7.2, 7.3 & Table 2 of the Zoning By Law so as to permit the division of land into two lots, each lot has an existing dwelling; would like to sell one of the dwellings and reside in the other; on the premises, located at the west side of Tolland Rd. and known as 26 Tolland Rd. The following members were present and voting: Frank Serio, Jr., Chairman; Alfred E. Frizelle, Esq.; William J. Sullivan; Walter F. Soule; and Augustine W. Nickerson. The hearing was advertised in the N. A. Citizen on June 26 and July 3, 1980 and all abutters were duly notified by regular mail. The petitioner seeks a variance for two parcels of land located on Tolland Rd.for the purpose of dividing the lot in two. At present there are dwellings located on each of the proposed lots. The petitioner testified that he purchased additional land abutting one of the lots to enable him to make the division with a larger lot; however, even with the purchase, the lot did not meet the requirements of the By--Law. There is also a shed located on the proposed lot line and the petitioner testified that he proposes to remove the shed if the variance is granted. On a motion made by Frizelle and seconded by Nickerson, it was voted unanimously to grant the variance as requested subject to the condition that the shed shown on the plans as 'being the proposed lot line be razed within 90 days after the effective date of this 'variance. In granting the variance, the Board finds that all of the requirements of Section 10.4 have been satisfied. The unusual size of the lot and location of the dwellings thereon makes enforcing the provisions of the Ey—Law a substantial hardship. In granting the variance the Board finds that it will not deregate from the intent or purpose of the By law and it can be granted without a detriment to the public good.
