Accordingly, the foregoing statement of ."reasons" must clearly indicate that the subject plan does not "show a subdivision", which is defined by G.L. c 41., Is* 81 L (as amended by St. 1963, c. 58Q), as follows: l fSubdivision" shall mean the division of a tract of land into two or more lots and shall include resubdivision, and, when appropriate to the context, shall relate to the process of subdivision or the land or territory subdivided; pro- aided, however, that the'di.vsion of a tract of land into two or more lots shall not be deemed to constitute a subdivision within the`meaning of the subdivision ` control law it, at the time when it is made, every lot within the tract so div-1- ' ' dad has frontage on' (a) a public way, or a way which the clerk of the city or Pu town certifies is maintained, and used as a blit way* or (b) "a way shown on a, Plan theretofore approved in accordance with the subdivision control law, or (c) a way in existence when the subdivision control law became effective in'the city or i town in which the land lies, having, in the opinion of the planning bcard, 'sufficiest width, sui.table,grades and adequate construction to provide for the needs of vehicular traffic in relation to the proposed use of the land abutting thereon or served thereby, and for the installation of-municipal ser- vices to serve such land and the buildings erected or to be erected thereon. Lyons, Town Clerk September 21, 1957 Town Building North Andover, Mess. Dear Sir: After duly advertised, a Public Hearing was held at the Toga Building on Monday evening, August 5, 1957, at WO P.M. The P3A=iug Board of North Andover voted that the petition of John F. Sawyer to permit the change in classification of a parcel of land from Rural Residence and Country Residence to General Business bo APPROVED. The Planning Board feels that by approval of this petition the town will benefit due to the increase in valuation of this property. The petitioner informed the Board that the proposed erection of a Garden Center would entail an expenditure of between 2 & 300,000 dollars. In making this decision, the Board took under consideration that there already exists opposite this location on Turnpike Street a large area of land zoned for business. Also, on the southwesterly side of the By-lass opposite this location there is a gasoline service station and a Concrete Products Company. This ]and is also zoned for business. Therefore, the Planning Board feels that the approval of this petition will not change the character of this area. In addition, no opposition was registered against the proposed Garden Center at the Hearing. Four members of the Bo&4" mre present and voted =animous3y on the above petition.
