Clerk APR 19 1126 AM '83 ACNE•+ TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS April 14 , 1993 Mr. Daniel Long, Town Clerk Joseph Scandore Town Office Building 76 Martin Avenue North Andover, Mass. Petition No. 21- 183 ;Dear Mr. Long; The Board of Appeals held a public hearing on Monday evening, April 11, 1983 upon the application of Joseph Scandore. The hearing was advertised in the North Andover Citizen on March 24 and 311 1483 and all abutters were notified by regular mail. The following members were present and voting; Frank Serio, Jr. , Chairman; Alfred E. Frizelle, Esq. , Vice Chairman; Richard J. Trepanier, Esq. , Clerk; William J. Sullivan; and Augustine W. ,Nickerson. The petitioner seeks a variance from the provisions of Section 7 , Paragraph 7. 3 and Table 2 of the Zoning By Law to allow the con- tinued use of a dwelling having less than the required side and rear setback requirements on premises located at 76 Martin Ave . The petitioner testified through counsel that the dwelling was con- structed approximately two years ago and when a recent plot plan was required by the bank to secure a mortgage, the violation was dis- covered. ,Upon a motion made by Mr. Trepanier and seconded by Mr. Frizelle . the Board voted four to one to grant the variance as requested. iMembers Serio, Frizelle, Trepanier" and Sullivan voted in favor of the motion and Member Nickerson voted in opposition. The Board finds that each of the conditions as set forth in Sectbon 10 . 4 of the Zoning By Law have been satisfied. In particular, the ' Board finds that due to the location of the dwelling on the premises with a slight deviation from the requirements of the By Law consti- tutes a hardship within the definition of the By Law.
