Dear Mr . Long:
The Board of Appeals held a public hearing on Monday evening ,
November 14 , 1983 ,upon the application of George H . Schruender ,
Jr . , The hearing was advertised in the North Andover Citizen on
October 27 and November 3 , 1983 , and all abutters were notified
by regular mail . The following members were present and voting :
Frank Serio , Jr . , Chairman ; Richard J . Trepanier , Esq . , Clerk;
William J . Sullivan ; and Associate Members Walter F . Soule and
Maurice S . Foulds .
The petitioner seeks a variance from Section 7 , Para 7 .3 and
Table 2 of the Zoning By Law so as to permit relief from the
front and side setback requirements to allow the continued
existence of a dwelling on premises located at 273 Greene Street .
The petitioner testified that the dwelling was constructed in 1953
and when a plot plan was recently required for conveyance purposes
the violation was discovered .
Upon a motion made by Mr . Foulds and seconded by Mr . Trepanier ,
the Board voted unanimously to grant the variance as requested .
The Board finds that Section 10 . 4 of the Zoning By Law has been
satisfied . In particular , the Board finds that a literal enforce-
ment of the By Law would create a hardship to the petitioner .

Permit Process
Dear Mr . Long :
The North Andover Planning Board held a public hearing on
October 19, 1987 , in the Town Hall Library/Conference Room upon the
application of Dr . George Schussell , 6 Windsor Street , Andaver , MA. The
hearing was duly advertised in the North Andover Citizen on October 1
and October e, 1987 . The following members were present and voting:
Paul Hedstrom, Chairman; George Perna, Vice-Chairman; John Simons,
Clerk ; John Burse and Erich Nitzsche.
The petitioner seeks a Special Permit under Section 8.3 of the
North Andover Z-oning Bylaw. The purpose of the Site Plan Review is to
review the proposal to construct a 19,675 square foot , three story
office building o i .e4 acres of land on the East side of the Andover
By-pass, in a Business-4 (B-4) Zoning District .
John Simone read the legal notice to open the public hearing .
Joseph LaGrasse presented the Board with the plans. Highlights of the
presentation were:
1 . Located on 80,000 square foot lot
2. 5,300 square foot footprint of building
3. Maximum employees - 65-70
4. Peak traffic - 35 cars per hour
5. 4 ' xB ' maximum sign - DIGITAL CONSULTING
6. A three story brick and glass building
7. Landscaping and buffer - to preserve existing trees
8. Height of building - 45 '
MOTION: By John Burke to continue the public hearing until November 23,
1987 .
SECOND: John Simons
VOTE: Unanimous
On November 23, 1987, the Planning Board continued the public
hearing on Diqital Consulting . Letters were read from various Town
Departments as well as State DPW. The following members were present
and voting : Paul Hedstrom, Chairman; George Perna, Vice-Chairman; John
Simons , Clerk: ; and John Burke. Erich Nitzsche was absent .
On a motion by John Burke to instruct the Planner to draft up a
favorable deci=sion incorporating all items the Department Heads have
come up with and sit down with the architect and go over the buffer
areas and close the public hearing and seconded by John Simons the Board
voted unanimously of those present .
On January 7, 19ee, the Planning Board held a regular meeting
with the following members present and voting : Paul Hedstrom, Chairman;
George Perna , VIce--•Chairman; John SImons, Clerk ; John Burke and Erich
Nitzsche.
On a motion by John Burke to approve as written along with the
amendments proposed by the Board at this time, seconded by Erich
Nitzsche. The Board amended the text on Condition 1 ,4,6 and omitted
conditions 7 and S. The Board voted unanimously to approve, subject to
the following conditions upon making a finding that the site plan
adhered to the requirements for Special Permits under Section 10.3.
The applicant resubmitted a site plan to the Board for review
which reflected the actual lot recorded at the Registry of Deeds Office
( Lot 2AA) . The Planning Board held a public hearing on April 14, 1988,
in the Selectmen ' s Meeting Room upon the application of Dr . George
Schussell , 6 Windsor Street , Andover , MA. The hearing was duly
advertised in the North Andover Citizen on March 10 and March 17, 1988.
The petitioner seeks a Special Permit under Section 8.3 of the
North Andover Zc:ning Bylaw. The purpose of Site Plan Review is to
review the proposal to construct a 19,675 square foot , three story
office building an 2.59 acres, more or less, located on the East side of
Andover By-Pass in a Business-4 (B-4) Zoning District .
The following members were present and voting : Paul Hedstrom,
Chairman; George Perna, Vice-Chairman; John Simons, Clerk ; Erich
Nitzsche and Michael Leary.
Discussion centered on the reasons for resubmittal by the
applicant . The applicant stated that the new filing was necessary since
the original site plan, voted by the Board , did not reflect the actual
lot which was on file with the Registry of Deeds Office. This
necessitated a refiling . John Simons asked if the lot was grandfathered
and not affected by the Town CBA Requirement . The applicant stated that
the lot is not required to meet the CBA standards of the Town.
Town Planner stated the only change to the site plan which was
approved by the Planning Board on January 12, 1988, was the actual lot
as now shown o} the site plan.
On a motion by George Perna to close the public hearing , stating
that all of the material contained in the original filing is part if the
new filing now before the Board , seconded by Erich Nitzsche, the Board
voted unanimously .

the original conditions stated in the decision filed on January 12, 1988
with the only change in the decision being the new revised site plan
which reflects the new lot size be added to the conditional approval ,
seconded by Ericr: 'liitzsche, the Board voted unanimously.
The Planning Board makes the following findings regarding this
Special Permit :
1 . The proposed use and site design for this lot are appropriate
due to its location in Town.
2 . Adequate vehicular and pedestrian access into and surrounding
the site has been provided .
3. The landscaping plan as shown meets the requirements of Section
8.4 of the Zoning Bylaw.
4. The site drainage system is designed in accordance with Town
Bylaw Requirements.
5. The applicant has met the requirements of the Town for Site Plan
Reivew a�, stated in Section 8.3 of the Zoning Bylaw.
Upon reaching the above findings, the Planning Board approves
this Special Permit based upon the following conditions:
1 . All signage included in the proposed development shall conform
to the requirements of the Zoning Bylaw.
2 . Show three (3) handicapped spaces adjacent to the structure.
Handicapped spaces shall be properly marked on the site.
3. All lighting shall be directed onto the site and no lighting
shall he cast onto any adjacent property.
4. Landscao ing plan as submitted indicates where new trees will be
planted as called for in Section 8.4 of the Zoning Bylaw. The
applicant shall provide fourteen ( 14) blue spruce pine trees.
Each tree shall be a minimum of 3 1/2" DBH at least 4 feet high
at the time of planting . These trees shall be placed adjacent
to the parking areas which front Hillside Road and Route 125.
Additional planting shall be provided which will completely
screen the parking areas and the proposed structure from
Hillside Road and Route 125 .
5 . Stone --nulls shall be constructed adjacent to the parking area
along Hillside Road and Route 125. The walls shall be
constructed to a height of 3 ' . The berms as shown on the
landscaping plan shall be removed .
6 . All existing trees as indicated on Sheet #1 of the site plan
shall he retained . A note shall be placed on Sheet #1 in the
areas indicated as existing tree cover as a "no-cut zone" .
Areas so indicated shall be maintained in the natural condition
which currently exists on the site. No cutting , grubbing ,
clearing or grading of any kind shall be allowed within the
"no-cut zone" .

The North Andover Planning Board held a public hearing on

On Nov,rir;L)er- 23, 1987, the Planning Board continued the public
rtoar3.r'og on Digital. Consulting . Letters were read from various Town

Clerk-; and John Bur1,:e. Erich iNitzsche was absent .
On a motion by John Burke to instruct the Plannersp a
favorable decision incorporating all items the DepartmentP

come up with and sit down with the architect and go overgf&lkd

the Board ; voted unanimously of those present . 1q 2 �3 P1{�q
On January 7, 1988, the Planning Board held a regular meeting
with the following members present and voting: Paul Hedstrom, Chairman;
George Perna , Vice-Chairman; John Simons, Clerk ; John Burke and Erich
Nitzsche.
On a motion by John Bukre to approve as written along with the
amemdments proposed by the Board at this time, seconded by Erich
Nitzsche. The Board amended to text on conditions 1 ,4069 and omitted
conditions 7 and 8. The Board voted unanimously to approve, subject to
the following conditions with the following findings:
The Planning Board makes the following findings regarding this
Special Permit :
1 . The proposed use and site design for this lot are
appropriate due to its location in Town.
2. Adequate vehicular and pedestrain access into and
surrounding the site has been provided.
3. The landscaping plan as shown meets the requirements
of Section 8.4 of the Zoning Bylaw.
4. The site drainage system is designed in accordance
with Town Bylaw requirements.
5. The applicant has met the requirements of the Town for
Site Plan Review as stated in Section 6.3 of the
Zoning Bylaw.
!Upon reaching the above findings, the Planning Board approves
this Special Permit based upon the following conditions:
1 . All signage included in the proposed development shall
conform to the requirements of the Zoning Bylaw.
2. Show three (3) handicapped spaces adjacent to the
structure. Handicapped spaces shall be properly
marked on the site.
3. All lighting shall be directed onto the site and no
lighting shall be cast onto any adjacent property.
4. Landscaping plan as submitted indicates where new
trees will be planted as called for in Section 8.4 of
the Zoning Bylaw. The applicant shall provide
fourteen ( 14) blue spruce pine trees. Each tree shall
be a minimum of 3 1/2" DBH at least 4 feet high at the
time of planting . These trees shall be placed
adjacent to the parking areas which front Hillside
Road and Route 125. Additional planting shall be
provided which will completely screen the parking
areas and the proposed structure from Hillside Road
and Route 125.
5. Stone walls shall be constructed adjacent to the
parking area along Hillside Road and Route 125. The
walls shall be constructed to a height of 3 ' . The
berms as shown on the landscaping plan shall be
removed.
6. All existing trees as indicated on sheet #1 of the
site plan shall be retained . A note shall be placed
on sheet #1 in the areas indicated as existing tree
cover as a "no-cut zone" . Areas so indicated shall be
maintained in the natural condition which currently
exists on the site. No cutting, grubing , clearing or
grading of any kind shall be allowed within the
"no-cut zone" .
The following plans shall be deemed approved by the Planning
Board : Plans entitled: Site Development Plan Headquarters Building
Digital Consulting , prepared by: Merrimack Engineering Services and
Joseph D. LaGrasse & Associates Architects, Plans dated: May 6, 1987,
revised October 19, 1987 and landscaping plan entitled: Headquarters
Building , prepared by: Joseph D. LaGrasse, Architects, plan dated :
September 4, 1987 , revised October 14, 1987.
