Dear Sir:
The following petition was heard at a meeting of the planning Board on
Tuesday evening, July 12, 1966 at the Town Office Building. Members present and
voting were: William Chepulis, Jr., Chairman; Robert J. Burke, Vice Chairs;
Howard Gilman, Secretary; James M. Bannan and George B. Farley.
JOIN-MREW CO. , INC. petitioned to subdivide land of William & Sthel Moore
and Edward V. & Anne Werenchxack, on Ghestnut Street, covering a total of
25.4 acres, in accordance with the plans submitted.
John J. Segadelli appeared for The Join-Andrew Go. and Charles C. Martin of
Brasseur Associates, surveyors, -was also present. There were eight abutters
present who were concerned mainly about the low water pressure in the area. The
subdivision comprises 16 house lots.
Mr. Gilman made a motion to take the petition under advisement. Mr. Barman
seconded the motion and the vote was unanimous.
In 13mcutive Session, after thorough discussion, Mr. Gilman made a motion to
approve the subdivision plans, subject to the following conditionse Mr. Burke
seconded the motion: and the vote was unanimous,
Conditions
1. That the record owners of the subject land forthwith execute and record a
ncovenant running with the land*, or otherwise provide security for the ccan-
stroetion of ways and the installation of municipal services within said sub-
division., all as provided by G.L. c. 1,1, p. 81-U.
2. That all such construction and installations shall in all respects conform
to the governing rules and regulations of this Board.
3. That, as required by the North Andover Board of Health in its report to this
Board, no building or other structure shall be built or placed upon Lots as shown
on said Plan without the prior consent of said Board of Health.

4. That water and sewer will be according to the rules and regulations of the
Board of ]Public Works.
5. That surface drains and street bounds must be installed; the construction of
streets and driveways shall be subject to the approval of the Highway Department.
6. The roads must be hot-topped and proper stmt signs installed. The turna-
round is to be completely hot-topped and the area at the turn of the road at lots
12 and 13 is to be hot-topped.
7. Approval is subject to the requirements of the Local and/or State Dept. of
Public Health regarding sanitary disposal systems.
8. Must comply with the Board of Fire Engineerst requirements as to the fire
alarm system,

Dear Sir::
The Planning Board held their regular meeting on Monday evening,
September 12, 1966 at the Torn Office Building. Members present gnti
voting were: William Chepulis, Jr., Chairman; Robert J. Burke, Vice
Chairmsn; Howard Gilman, Secretary and George Farley. James M.
Bannan did not attend.
Mr. Jahn Segadelli appeared before the Board regarding his proposed
sub-division off Chestnut Street called eHillaide Acres". He re-
quested that the Board consider a revised plan of the turnaround,
which the Board had stipulated should be completely hot-topped. He
desires a 3/+ foot finished roadway and a grassed center plot.
The Board voted unanimously to amend the decision of July 15, 1966 by
eliminating the portion of condition No. 6 which reds 'The turna-
round is to be conpletely hot-topped* and that the Board will accept
the revised plan of the turnaround which is to be hot-topped and con-
structed as shown on the plan dated September, 1966.
All other conditions as listed in the decision of July 15 will still
apply.

Dear Sirs '
The following petition was heard at a meeting of the Board of Appeals on Monday
evening, September 20, 1965 at the Town Office Building. Members present and
voting weres Daniel T. 0#Leary, Chairman; Tobn J. Shields, Arthur Drummond,
James Deyo and Associate Member Howard Gilman who eat in place of regular member
William Morton.
J. J. SEWMLI, INC. requested a variation of Sec. 6.32 & 6.33 of the Zoning By_
Law so as .to permit the sub-division of a parcel of land into two lots, each lot to
contain approx. 40,900 sq. ft., having a greater frontage on Essex Street than is
required under Sec. 6.33 of the Zoning By-Uwe, on the premises, located at the
north side of Essex Street at the Boxford town line.
This publ4c hearing was advertised in the Eagle Tribune on September 4 & 13, 1965.
All abutters were duly notified by certified mail of this hearing.
There were eighteen people present. Atty. John J. Lynch represented the petitioner.
The original lot to be subdivided contained approx. 81,000 sq. ft. Under this sub-
division Lot 6A would contain 40,900 sq. ft. and 6B would contain 40,901 sq. ft.
The street frontage of each lot would contain more than the minimum requirements of
150 feet. Six people were recorded as opposed. Two were recorded in favor.
In Executive Session Mr. Shields made a motion to GRANT the variance, Mr. Gilman
seconded the motion and the vote was unanimous. The Board voted to grant the
variance for the following reasons.
a.) The subject premises are located in the Rural Residence Zone, as defined by
the By-law, which requires a street frontage of 150 feet and a lot area of /+ .000
sq. ft. (section 6.33).
b. The applicant is a builder and contractor and the land had already been sub-
divided by the previous owner. The various lots have been recorded, bearing Planning
Board certifications that that Board's approval of them was not required under the
subdivision control law; five lots have been sold and this one remains with the
request to sub-divide it..

d. Were the requested variance to be granted, and conforming dwellings}omstracted
upon each parcel, as the applicant intends, no observable zoning non-conformity
would appear to any passerby, nor to any adjacent landowner.
e. The proposed lots would not be in derogation to the neighborhood.
f. There exist certain conditions, especially affecting the parcel in question,
which do noir generally affect the entire zoning district in which the parcel is
located.
g. The Board sees no derogation to abutting properties or to existing neighborhood
influences. ,
h. To deny the said petition would result in a substantial hardship, financial or
otherwise; the best end-use of the land would be denied and the town as well as the
applicant would suffer hardship.
