P, Stevens Compomy Lyons, Tows Clerk (Osgood Mills property) Town Office Building Petition No, 23-173 North lndover, Mass, Dear Sirs A public hearing was held by the Board of Appeals on November 12, 1973 upon application of J. P. Stevens & Go., Inc.# who regaested a variaticm of See, 6.2 & Table 2 of the Zoning By—Law so as to permit for the purpose of conveyance, a lot of land not having the requi rod frontage on a plc way; an the premises located at the north side of Main Street, approx. 200 feet from the career of Water Street (the Osgood Mille property). The following members were present and voting: Dr. Eugene A. Beliveau, Acting Chairman; William N, 3alown; Louis DiFruscio; Alfred E. Friselie, Esq,, Associate Member and James D. Noble, Jr., Associate Membera The bearing was advertised in the Lawrence Eagle-Tribune as October 27 and November 3, 1973• All abutters were duly notified by regular mail. Atty. Clifford E. Elias represented the petitioner. Also present were Horace Stevens, Vice President of d, P. Steven Co. and Norman Kneiasler, Vice President of Konica Corp., the prospective purchaser. Atty, plias explained that it was necessary to prepare a plan for recording purposes in order to cavey the Osgood Mills property. Since the lot does not have the required frontage under the present Zoning By-Law, there was some question as to whether the Planning Board would endorse it and the Building Inspector had stated that a building permit could not be issued for the work which was planned for the mill building, The use of the building and property and the *is* of the let conform with the Zoning Bylaw; however the lot has only 32 feet frontage on Main Street, which frontage was allowed under the 1943 Zed BY—Law. Chairman Edward Phelan, Board of Assessors, spoke in favor of the petition stating it would help the tax base of the town and Provide employment. There was no opposition to the petition, gtty. Friselle made a notion to take the petition under advisement; Mr, Moble seconded the (motion. and the vete was unanimous. The Board met again on November 26,1973; however Acting Chairman Beliveau was unable to be present so that action was taken by a four-san Board, Mr. Salomme Y J. P. Stevens Comparq - .. Rovember 29, 1973 (Osgood'Mills) made a Motion to GUM the variance; Associate Member Friselle seconded the motion and the vote was unanimous, The Board found that there were conditions affecting this parcel of land which did not affect the zoning district in general. That the frontage of 32 feet had been that way since 1950 when the 1943 Zoning By-Law was in effect and that there was na other land available to provide more frontage to meet the existing frontage requirement of 150 feet, That the literal enforcement of the provisions of this By-Law would involve substantial hardship, financial or otherwise. That relief could be grunted by this Board without detriment to the public good and without nullifying or sub- stantially derogating from the intent or purpose of this By-Law.
