Tessler, 308 Camp— bell Road requesting a variance from the requirements of Section 4, Paragraph 4.121(6) (b) of the Zoning Bylaws so as to permit keeping horses on property containing less than three (3) acres. They have 2.851 acres. The following members were present and voting: Frank Serio, Jr., Chairman, Augustine Nickerson, Clerk, William Sullivan, Anna O'Connor and Louis Rissin. The hearing was advertised in the North Andover Citizen on May 26 and June 2, 1988 and all abutters were notified by regular mail Upon a motion made by Mr. Sullivan and seconded by Mr. Nickerson, the Board voted to DENY the variance as requested. The vote was four (4) to deny and one (1), Mrr. Rissin to,-grant this petition. The Board finds that the petitioner has not satisfied the provisions of Section 10, Paragraph 10.4 of the Zoning ByLaw and the granting of this variance would derogate from the intent and purpose of the Zoning ByLaws. The Board also finds that a similar petition on this same parcel of land was previously denied on Oct-ober. 23, 1980 and- that' -Its dapision was upheld by the Superior Court #19047, dated December 9, 1981.
