Lyons, Town Clerk Town Building North Andover, Mass. Dear Sire The following petition was heard at a meeting of the Board of Appeals on Monday evening, January 15, 1962 at the Town Office Building. Members present and voting were: Daniel T. O'Leary, Chairman; Harold Morley, Secretary; Robert J. Burke, Henry E. Lund and Associate Member Alfred Boeglin who sat in place of regular member Howard Gilman. Tidewater Oil Company requested a variation of Sec. 6, para. 6.43. and Sec. 7, para. 7.3 of the Zoning By—Law so as to permit the erection and operation of a gasoline service station, on the premises, located at the northeast side of Massachusetts Avenue, 300 feet, approx., distant from the corner of ferry Street. This public hearing was advertised in the Nagle Tribune on December 23, 1961 and January 5, 1962. All abutters were duly notified by certified mail of this hearing. Mr. Ralph Warrington, real estate representative for Tidewater Oil Co. ; and Mr. R. Smith, Engineer for Tidewater Oil Co. appeared before the Board. There were no abutters present and there was no opposition to the petition. The Board discussed and voted on the petition. Mr. Burke made a motion to GRANT the variance. Y cBdeglJ3V seconded the motion and the vote was unanimous. This is an appeal from that portion of section 6.41 of the Zoning By-Law requiring each lot in a general business area to contain not less than 25,000 square feet, the subject lot containing 18,000 square feet, more or less, and a further appeal from that portion of section 7.3 requiring no building or structure to be erected within 25 feet of the front lot line. The lot in question is bounded northwesterly and northerly by the Shawsheen River, southeasterly by property currently used as a restaurant and southwesterly by Massachusetts Avenue, a state highway. The only possible business use for a parcel of this size is one that requires the erection of a small building, such as a gas station as in the present instance, and the variance under section 6.41 is hereby granted. ( O;NORTk9,y F% Avna7m :S+ •R�I- C 1 s� *rwr1 TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS -2- January 22, 1962 The main building to be erected as shown on applicant's plan, is set back the required twenty-five feet, the only structure lying within the front yard space being a permanent-type canopy containing fluorescent lighting and the gas pumps. The purpose of this particular type of canopy being to better serve the commmity in a protected atmosphere and to keep t*e lighting on the service area rather than the general area. The variance requested to construct the canopy and pumps within the twenty-five foot front yard area as shown on applicantts plan is hereby granted. Owing to conditions especially affecting this parcel of land but not generally affecting the zoning district, a literal enforcement of the provisions of the by-law would involve substantial hardship to the appellant and the granting of these variances will enhance the general appearance of the area without substantially derogating from the intent and purpose of the zoning by-law.
