Timmons 203 Dale Street Petition x'73 dohnd. Lyons, Toed Clerk Tom*n Wfice Building North Andover, Masa, Dear Sir: A public hearing was held by the Board of Appeals on duly 9. 1973 UP= appli4ation of Mrs. Ruth 1. Ti=nons who requested a variance under Section 6.2 of the Zoning By-Law so as to permit to be subdivided into two lots, a three acre parcel having less than the required frontage for two lots; located at the southerly side of Dale Street and known as 203 Dale Street. The following members were present and voting: Frank Serio, dr., Chairman; Dr. Began A. Beliveau, Cleric; William R. Womme, Louis DiFruscio and Associate Member Alfred E. Frizelle, Esq, who sat in place of member Arthur R. Drummond. The hearing was advertised is the Lwaince Eagle-Tribume on dune 23 & 30, 1973 and all abutters were duly notified by regular mail. Atty. Harold Morley, Jr. represented the petitioner and explained that this three acre parcel of land was purchased many years ago and that now then petitioners am would like to build. This is an unusually shaped lot in that it contains three acres but does not contain sufficient frontage to meet the zoning requirements. The petitioner tried to obtain land from an immediate abutter in order to provide sufficient frontage but was unable to do so. The present driveways would provide the access to the second lot. The petitioner would be agreeable to any conditions that the Board might place. There was no opposition. Mr. Ted Peters, an immediate abutter, was in favor of the petition. Mr. DiFruseio made a motion to GRAIT the variance subject to certain canditionst Mr. Salemme seconded the motion and the vote was unanimous. The condition are: 1. That the frontage of the lots be 75 feet. 2. No further subdivision of these lefts will be made. 3. The vacant lot is to be conveyed to dames Timmons and the house is to bs built in the middle of the lot as specified. s Mrs. Ruth M. Timmons —2- July 14 1973 The Board found that under Section 6.2 of the Zoning By—Law a minism= of 75 ft. frontage can be allowed and by diTiding the land in this way the petitioner would be allowed the use of her land as requested, very tray Few• BOARD OF APP&G S Frank Seriol Jr., Chairman AD i `yaa ♦ NORTy9 :13:.°A►1r cam-: Avna7ty '' I$55 • ' t ps SgCH6BF' a rrrwv+K TOWN OF NORTH ANDOVER MASSACHUSETTS 1 BOARD OF APPEALS NOTICE OF DECISION Date .
