Nieetta Moved that the petition be granted, Mr. Boegl'~n eeconde4 t~ motio~ it was w-n~ously carried. The Board signed vouchers for stamps and pest-card~, and the elerkts wages. June 1956 , .Public Hear - The Hearing was o~lled to order at ,~45 P. ~ Members present: Ralph Fin~k, Chairman, Kenneth Terroux, Alfred Boeglin~. Secretary, Nicholas Nicetta and Associate Member, Benedict Perrone. Mr. Chair~am appointed Benedict pert°ne, Associate Member to sit in place .of the absence of Mr. Lurid. Mr. Ohair~n read the application to a3~ present. Mr. Gilman made application for a gasoline station. Mr. Nieetta expressed generally most oil companies have a plan shoving ~bat is to be located on the lot such as pumps, etc., and the frontage is approximately 40 or 50 feet. Mr. Ohair~mn questioned if anyone was in fa~--. No. one answered. He then questioned if anyone was in favor. A_nn~ ~reeley, attorney for Bertha ~orrell stated Mrs. Morrell sold the parcel of land in question to Mr. Colgate. She has .~de an agreement to sell the ~est of her 1-~& including her house. She would not anticip ate that this agreement w~]~ not be full-filling, but in any event if so__-~_tht~ should e~cur MrS. Morrell would have difficulty In selling the property., Mrs. Morr_~11 thought the area would be used for houses not a gasoline station. ~ohn Erwi~ . Engineer for Western Electric replied that at this writing, we ~mot : object, nor d~ we condone it. He stated ho did not ~-ow it was adjacent to the property. He gave the Board this address, so as we do not h~ve to contact the Ne~ York Office in cases such as this. John F. Erwin 16OO Osgood Street North Andover, Mass. ~r. Cb~rm~ aSked the petitioner if he wished to defer action on the petition ~atil a plot plan was submitted. Mr. Gilman, petitioner, agreed to this action. The second hearing was on the application of Gerard Prou~x, who wishes to erect a riding aCademy. Mro Pro-lY took the floor and stated it would be a horse-back riding school, with an outdoor ~r. Beck who owns the property stated he is sell~ because of ill health, and thinks it ~lll be asset to the Town such as new lives, and more taxes. Attorney Thompson, representative for Mr. Beck, stated he 'couldn't guess of any opposi- tion to the matter as it is merely a continuance of an animal business. It would mot be detrimental to anybody. He stated it seemed, as we have now come to real~ ze, that North Andover is a growing eo~,~nity~ having dirth of recreational facilities. ~ In a sense, he stated, it is a kind of recreation for people interested i~ riding horses, not only for the enjoyment, but for t~e physical e~ercise. He expressed for the entire benefit of the whole commnnity, it would increase taxes to the To~n. He did not believe anyone could object because of the v~stness of the area involved.- The applicant has ~ conducted a similar ridi~ school in Andover. Houghton Farnham, an abbuttor, was opposed to the petition for the following-~ reasons. The. outdoor ri~o~ rink will be 75' near the living quarters of his residence~ which iS the rear part of the house. There will be odors from this farm, a lot of dust caused from' riding, as far as riding is concerned, there is only one street. He stated that there ~ be "cow-Boys" riding the back roads. He has property for sale, and feels if the riding academy is there, it will hinder the sale of the land. Gu~ P. ichards, abbuttor was also opposed to the petition. He stated he lives across the street, and has two childred in such a~ situation as this, it is easy for them to get hurt. Mrs. Proulx stated that th~ey do not allow any "cow-b~ys" riAing, and are interested in people who enjoy riding. Mr. Farnham stated the building they are going to erect will come directs in the rear of h~s ho~se 150~ from the piazza, and it is ridiculous to contemplate of even having a riding school.~ He brought out the petites-er made an application *~ar' to this one in Andover, but was turned down. Mr. Farnb_~ brought out that _the riding rink is someth~_~g a person would see in the circus. Mr. Thompson stated the school in Amdover is properly co~ucted in an area a ~ deal ~a~..ller 't_h~_~ the one in question, and it 'is ri~tous to think of it as a circus aspect. The horses are kept in a proper way. He stated it seemed ra~h~r selfish, if one mo~es into an agricultural area not to be allowed to keep horses. Mr. Chair~ questioned the petition, er as to the number of horses he would bring' The reply was 40 horses. The indoo~ rink would be used in bad weather, and the outdoor rink for classes. Mr.~- ohairm~ said the application was for an indoor ring only and was misleading to the public. Mr. Richards who ownes 3 horses l~ought out that 3 and 40 horses ~as a great deal of d~_~fere~ce. Mr. Houghton expressed the same sentiment as Mr. Ric~e~ds in the number of h~rees. Mr. Beck stated he had as much as 40 co~s' and other livestock i~ great nu~. rs. The area i~ question .is 47~ acres. Mr. Houghton stated if ~he petitioners land was a m~le or half .s m~le away he would have not objection. He stated he had no objection if the business end was conducted away ffrom his ho~ ' Mr. ~ichards stated it would bring the valuation Mr. Proulx stated if the pe%it~on were granted, he ~as going to sell the one in Andover. Ir, Boeglin moved that the petition be taken u~der advisement, Mr. Terroux seconded this motion. Allwwere in favor. Mr. 01enio came before the Board and stated the Aziz permit has a victualers liconee, and he would also like one. The Board agreed that it ~ho~ldn~t be on the permit. Mr. Nieetta moved that ~e so inform the Board of SeleCtmen not to write on any applications such as this, t~] the .Board of Appeals reviews them first. Mr. Kennedy appeared before the Board, and t~ Chairmam ~eorme~ him due to ~r. Lund's absence they could not act on his plans. The meeting adjourned .at 9=30 P. M. Clerk
