Dear Sir: A public hearing was held by the Board of Appeals on May 11+, 1973 upon application of Douglas I. Treadwell who requested a variance under Sections 6.3 and 6.8 of the Zoning By-Law so as to permit the erection of a two—stall garage with a family room above, located at 26 Hemlock Street. The following members were present and voting: Frank Serio, Jr., Chairman; Arthur R. Drummond, Vice Chairman; Dr. Eugene A. Beliveau, Clerk; William N. Salemme and Louis DiFruscio. The hearing was advertised in the Lawrence Eagle—Tribune on April 2$ and May 51 1973 and all abutters were duly notified by regular mail. Mr. Treadwell appeared on his own behalf and explained that the addition would be 10 feet from the lot line and measure 24 ft. by 24 ft. He had discussed the addition with the Building Inspector and did not realize that the chimney should also be shown on the plan, which would make it two feet closer to the lot line. The Zoning By—law requires a side setback of 12 feet on undersized lots, and 20 ft. front and rear setbacks. William McEvoy, an immediate abutter, spoke in favor of the petition. There was no opposition and no one else spoke. The petition was taken under advisement and during that period was reviewed by the Board. Mr. DiFruscio made a motion to GRANT the variance; Mr. Salemme seconded the motion and the vote was unanimous. The plans are to be corrected to show the chimney on the addition. The Board found that the variance would not be in sub— stantial derogation from the intent and purpose of the Zoning By—law; that it would not adversely affect the neighborhood and that there would be a hardship, financial or otherwise, if the petitioner were not allowed to provide additional living space to his dwelling.
