Premises Affected: 308 Campbell Rd. Petition No. 22-'80 Daniel Long, Town Clerk Town Office Building North Andover, Mass. Dear Sir: A public hearing was heard by the Board of Appeals on September 15, 1980 upon application of Lisa M. Treat who requested a variation of Section 4.121 (6b) of the Zoning By-Law so as to permit the keeping of a horse on land with less than the required three acres. The hearing was advertised in the North Andover Citizen on August 28 and September 4, 1980 and all abuttors were notified by regular mail. The petitioner seeks a variance of Section 4.121 (6b) of the By-Law to enable her to purchase property located on Campbell Road. The petitioner testified that the property has a barn and would be suitable to enable her to keep a horse. The By-Law specifically provides that at lease three acres of land are xrequired. Upon a motion made by Mr. Frizelle and seconded by Mr. Sullivan, it was voted to deny the requested variance. The Board finds that the petitioner failed to satisfy the provisions of Section 10.4 of the By-Law. Plaintiff is an individual who resides in Revere, Massachusetts. 2. The Defendants, Frank Serio, Jr. , Alfred E. Frizelle, William J. Sullivan, Augustine Nickerson, are members or associate members of the Zoning Board of Appeals of the Town of North Andover, who rendered the decision being ! appealed from. f j 3. Plaintiff filed an application for a zoning variance on property located at 308 Campbell Road in North Andover, Massachusetts. 4. This variance sought to allowthe Plaintiff to keep a horse on the land with less than the required three acres 5. On September 5, 1980, the North Andover Board of Appeals held a hearing on Plaintiff's application and there was no opposition to the application:. On October 23, 1980, the Defendants issued a decision denying the variance, a certified copy of which is attached as Exhibit "A" . 6. In its decision, the Defendants made findings of fact which are erroneous d and exceed the authority of the Board in that they were not supported by any credible evidence: 7. The Defendent, Zoning Board of Appeals, failed to make and provide specific reasons for its decision as required by General Laws, Chapter 40A. 8. The Board exceeded its authority by erring in the application of the laws pertinent to this petition. 9 The Plaintiff asserts that the Defendants', Zoning Board of Appeals decision is contrary to both the law and the facts submitted i P <. WHEREFORE, the Plaintiff requests the following relief. I. That the Court annul the decision of the Board. 2. That the Court rule that the Plaintiff be entitled to her variance. 's ii 3.
