Nov i6 ID 57 AN '83 TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS November 15 , 1983 Mr . Daniel Long , Town Clerk Judith W . Twombly Town Office Building 140 Prescott St . North Andover, Mass . 01845 Petition No . 68- ' 83 Dear Mr . Long : The Board of Appeals held a public hearing on Monday evening , November 14 , 1983 upon the application of Judith W.` Twombly . The hearing was advertised in the North Andover Citizen on October 27 and November 3, 1983 and all abutters were notified by regular mail . The following members were present and voting : Frank Serio, Jr . , Chairman ; Richard J . Trepanier, Esq . , Clerk ; William J . Sullivan ; and Associate MembersWalterF . Soule and Raymond A . Vivenzio . The petitioner seeks a variance from the provisions of Section 7 , Paragraph 7. 3 and Table 2 to permit relief from the side set- back requirement to allow the continued existence of a dwelling (townhouse ) which does not meet the side setback requirement of the Zoning By Law on premises located at 140 Prescott Street . The petitioner testified through counsel that the dwelling ( unit) was constructed in 1980 and when an "As Built" plan was required the setback violation was discovered. The townhouse unit is set back 17 feet where 25 feet is required under the Zoning By Law . Upon a motion made by Mr . Trepanier and seconded by Mr . Soule , the Board voted four to one to grant the variance as requested . The Board finds that Section 10 . 4 of the Zoning By Law has been satisfied. Specifically , the Board finds that due to the loca- tion of the townhouse unit on the property with its slight devia- tion from the requirements constitutes a hardship to the petitioner . Said variance may be granted without nullifying or substantially derogating from the intent and purpose of the Zoning By Law .
