Street/Marbleridge Road - Watershed District
Dear Mr . Long:
The Planning Board held a public' hearing on Monday evening,
February 27, 1984 in the Town Office Meeting Room upon the
application of Robert Forget, 280 Salem Street, North Andover. The
hearing was duly advertised in the North Andover Citizen on February
2 and 9, 1984. All abutters were notified by mailrin accbrdance with
M.G.L. , Chapter 40A, Sed. 9. The following Planning Board members
were present: Michael P. Roberts, Vice Chairman; John J. James, Jr . ,
Clerk; John J. Burke; and Erich W. Nitzsche.
The petitioner seeks a Speclal' Permit under Section 4.133(d) of
the zoning bylaw which requires a Special' Permit to allow
construction within 100 feet horizontally from the edge of all"
tributaries of Lake Cochichewick. The premises is known as Lot 3,
located on the west side of Marbleridge Road having a total area of
33, 296 s .f. and 298. 38 feet of frontage; and Lot 4 located on the
north side of Salem Street with 28,399 s.f. of area with 353.30 feet
of frontage. Both lots are in the Residential=3 (R-3) and Watershed
zoning District.
The proposed single family, wood-framed dwellings will' have the
following dimensions:

At the hearing, the applicant testified through his
representatives, Mr . Joseph Cushing of Kaminski Associates, Inc': , and
Attorney George Rand, the following:

-The applicant is before the Planning Board for the third time
regarding the same two lots . The engineer has redesigned the shape
of the dwellings and has positioned them, along with proposed
regrading further away from the tributary. The two previous
proposals required the applicant to seek variances from the Board of
Appeal's under Section 4.133(c) Watershed District to install--a sewer
lune within the 25 foot no cut buffer zone. The Board of Appeal's
will- not vary the 25 foot buffer requirement, thereby rendering the
original plans as', non-develbpable.
-Furthermore, Mr.' Cushing stated that there will- be no endkoachment
by either building or grading within 30 feet of the 170 foot contour
(edge of statutory wetland) . Haybale erosion cbntrol' measures will'
be in place between the proposed construction and E1`. 170, as noted
on plans dated 1/'6/84, revised 3/1/84.
-As a result of this refined plan and relocation of sewer connection,
the environmentall' impact of cbntruction is significantly less than
that originally proposed under previous petitions.
The following members were present and voting at the March 19,
1984 meeting when the Planning Board rendered its decision:
Michael P. Roberts, Vice Chairman; John A. James, Jr. , Clierk; John J.
Burke; and Erich W. Nitzsche.
Upon a motion made by Mr. Nitzsche and seconded by Mr. James,
the Board voted to grant the Special' Permit requested, subject to the
following:
1 . Only the proposed work as shown on the plan entitled ' Site Plan
North Andover, Ma. , prepared for Robert Forget' by Richard F.
Kaminski and Associates, Inc': , dated 1/6/84, revised 3/1/84 is
allowed under this permit. Any minor changes meeting the intent of
said plan and determined to have lesser impact on the wetland
tributary must be approved by the Planning Board prior to
implementation and reflected in the final' plan.
2. Upon final completion of grading and construction, a certified
as-built plan from a Registered Professional' Engineer and/or
Registered Land Surveyor shall be submitted to the Planning Board for
review of compliance with the Special' Permit conditions. Said
certification will' state that the as-built grading and construction
fully complies to the approved plan with revisions noted.
3. All' construction shall- comply with any Conservation Commission
order of Conditions.

4. No work shall;' be permitted at or be16w the 170.0 contour line as
it presently exists .
5. No basement floor will- be set lower than El'. 172.0.
6. A driveway entry permit shall' be obtained from the Highway
Surveyor, whereby the applicant shall' consult with the Highway
Surveyor regarding the location of Lot 4 's driveway entrance
proximity to the Salem Street/Marbleridge Road intersection.
7. Any departure from said conditions of approval' shall"render this
Special Permit nulland void.
In granting this Special' Permit, the Planning Board finds,
pursuant to Section 10.31 - Conditions for Approval- of Special'
Permits of the Zoning By Law, that the following conditions are met:
a) Lots 3 (Marblleridge Road) and 4 (Salem Street) is the appropriate
location for the construction of the proposed single family
residential uses;
b) The residential use permitted in that zoning district will'-' not
adversely affect the surrounding residential- neighborhood or
Watershed, since said plans and conditions minimize any impact to the
denoted wetland area and brook, and is a continuation of its allowed
surrounding residential uses ;
c') In compliance with conditioned approval', there will, be no
nuisance or serious detrimental- hazard to vehicles or pedestrians;
d) Adequate and appropriate fac1lilties, inclusive of the town sewer
and water connection, will' be provided for the proper and efficient
operation of the proposed residential' use,
e) Based on site visits, the public hearing process, and review and
input by appropriate town boards and departments, the single family
use is considered to be in harmony with the general' purpose and
intent of the North Andover Zoning Bylaw.

Dear Mr. Long:
Attached please find the following amendments approved at the January 21,
1985 Planning Board meeting regarding the above referenced Special Permit
decision filed in your office on March 20, 1984.
Plan dated 1. Lot 4 (5A on attached plan) has been granted the revision (in
1/8/85 accordance with Condition#1) to move the dwelling 10 feet further
into the site. The property line along Salem Street is closer to
the dwelling, thus requiring the proposed house location to be changed.
Plan dated 2. Lot: 3 (4A on attached plan) has been granted the following
1/19/85 amendments ( in accordance with Condition#l);
a. The dwelling size shall become 68 x 27.
b. Retaining wall shall be installed in the rear
of the proposed dwelling and at the northeast corner
of the dwelling.
c. A paved dogleg shall be permitted at the rear portion .
of the driveway.
All conditions on the decision dated March 20, 1984 and plan dated March
1, 1984 shall continue to be in effect until the time of completion.

Dear Mr. Long':
The Board of Appeals held a public hearing on Monday evening, Febru-
ary 14 , 1983 upon the petition of Robert Forget. The hearing was con-
tinued to March 14 , 1983 and again to March 29 , 1983. The hearing was
advertised inithe Lawrence Eagle Tribune on January 31 and February 7 ,
1983 and all abutters were notified by regular mail. The following
members were present and voting : Frank Serio, Jr. , Chairman; Alfred E.
Frizelle, Esq. , Vice Chairmanp Richard J. Trepanier, Esq. , Clerk;
Augustine W. Nickerson; and Walter F. Soule .
The petitioner seeks a variance from the provisions of Section 4. 133
Paragraph 3 '(c) of the Zoning By Law to permit disturbance of vegetation
within twenty five feet (25 ' ) of a tributary to Lake Cochichewick on
premises located at the corner of Salem Street, Marbleridge Road, and
Dale Street.'
The petitioner testified through counsel and the project engineer that
a Special Permit was granted by the Planning Board allowing the con-
struction of 'a sewer line through the property, being a triangle located
at Dale Street, Marbleridge Road and Salem Street. The variance is
necessary because there is a stream, which is a tributary to the lake,
which crosseO down through the heart of the triangle and the Zoning By
Law states ,tllat "a no cut buffer zone shall exist 25 feet horizontally
from the edge of all tributaries in the Watershed. " The petitioner's
home is looated at 280 Salem Street and in addition to servicing his
own dwelling, he proposes to service three new lots on the premises .

A motion was made by Mr. Nickerson and seconded by Mr. Soule to grant
the variance as requested. The motion failed three to two, with members
Serio, Nickerson and Soule voting in favor of the motion and members
Frizelle and Trepanier voting in opposition.
Therefore, the petition is denied.

evening , September 13 , 1982 in the Town Office Meeting Room upon
the application of Robert Forget. The hearing was advertised in
the North Andover Citizen on August 19 and 26 , 1982 and all abut -
ters ;-were notified by certified mail . The following members were
present and voting : Paul A. Hedstrom , Chairman ; John J . Burke
and Erich W . Nitzsche .
The petitioner seeks a Special Permit under Section 4 . 133 , Para-
graphs 3 (c) and 3 (d) of the Zoning By Law so as to permit the
construction of four new dwellings and alteration to an existing
dwelling with associated utilities located within one hundred ( 100)
feet of a tributary to Lake Cochichewick and removal of vegetation
within twenty five (25 ) feet of a tributary to Lake Cochichewick
on lots of land located within the Watershed District and known as
280 Salem Street ; Lot 2 , South side of Dale Street ; Lot 3 , South
side of Dale Street ; Lot 4 , West side of Marbleridge Road ; and
Lot 5 , North side of Salem Street .
The site affected is located in the R-3 District , possessing an
area of 3 . 72 acres with total frontage of 1 ,205 feet . The pro-

Mr . Joseph Cushing , project engineer , indicated the applicant
intends to take the parcel and develop it for four additional
house lots as shown on the plan dated May 4 , 1982 .
A sewer line will be installed to connect to the five dwellings .
The Board of Public Works has reviewed the plans and finds them
acceptable and consistent with the 1972 Master Plan .
Several abutters were present voicing concerns regarding the
current water problem in the area . Mr. Forget testified through
his counsel and engineer that the Conservation Commission has
prohibited them to fill below elevation 169 feet . Any fill
above 169 feet will have no affect on abutters ' property ; thus ,
increasing run-off will not occur .
Per a request of the Highway Surveyor , the applicant agreed to
provide drainage easements for maintenance reasons which will
ensure the proper flow of water .
Upon a motion made by Mr . Nitzsche and seconded by Mr . Burke ,
the Board voted to grant the Special Permit subject to the
following conditions . Due to the extent of on site wetlands
and to limit the potential downstream affects from development ,
the conditions address the safeguards deemed necessary to
protect the neighborhood .
1 . Modify ,said plan to accomodate three (3) new buildable house
lots ( as opposed to the proposed four (4 ) , which will ensure
that the intensity of the proposed use will remain in harmony
with the general purpose and intent of the Wetland By Law ,
and will not pose an environmental threat to surrounding areas
2 . Require the plans to be revised to mitigate the increased rate
of runoff to zero (0) . Provide compensating storage to account
for all filling within the wetland as well as the increased
rate of run-off from development . Compensating storage cannot
be created below the existing 170 .0 foot contour line .
3 . Provide in satisfactory form a deed of easement or conservation
restriction for all the area below the proposed 170 foot contour
to insure that it will not be filled in the future . Said re-
striction to be placed in the deed . No work will be allowed
below the 170 foot contour line as it presently exists with
the exception of the sewer installation .
4. Provide in satisfactory form a deed of utility easement to the
Town of North Andover ,

5 . Provide in satisfactory form a new plan for recording in the
Registry of Deeds showing appropriate easements fully di -
mentioned , including the private sewer crossings .
6 . Provide invert elevations on the 30 inch drain crossing
Salem Street .
7 . The ;North Andover Conservation Commission will be notified
after erosion controls are installed for insurance of
compliance prior to performing any work on the site .
:8. No finish floor will be set lower than elevation 172 . 5 .
9 . Any disturbed or exposed earth to be left for more than two
(2) months or over winter will be cleared of debris , loamed ,
and seeded .
10 . Submit revised plans and drainage calculations for approval
by the Planning Board to insure strict compliance with the
conditional approval .
11 . Require an "AS BUILT" plan to be submitted for approval prior
to the issuance of occupancy permits to be certified by a
Registered Professional Engineer stating that the work per-
formed is in compliance with the approved plans .
12 . The Building Inspector will be notified that no Certificate
of Occupancy will be issued on any of the dwellings without
the approval of the Planning Board ,
13. No building permit will be issued until all work , including
but not limited to , the compensating storage area and the
water and sewer lines has been completed including final
loaning and seeding .
14 . Require that the proposed 170 foot contour line be staked out
on the ground and notify the Planning Board for inspection .
The 170 foot contour stakes shall be maintained throughout
all construction .
15 . The area where fill is placed shall be delineated on the
revised plan and staked out on site , including the sewer
lines ' to show actual work limit . The Planning Board shall
inspect and improve this work prior to any work being
performed .
16 . There will be no cutting of any trees outside the work limit .
17 . All trees (6 inch dbh ) within ten ( 10 ) feet of the sewer and
water services will `be located and shown on the plans to in-
sure that they are not cut .

18. Any and , all trees cut outside the approved work limit will
be replaced in accordance with the Planning Board ' s Rules
and Regulations .
19 . Upon final grading , all disturbed areas will be covered with
six ( 6 ) inches of loam and seeded .
20 . Any violation of these conditions shall render this Special
Permit null and void . Alternatively , the Planning Board may
require the applicant to remove and/or restore any areas
violated .
21 . In accordance with the Fire Department ' s letter dated Sep-
tember 2 , 1982 , each lot owner will consult with said de -
partment concerning the underground storage of fuel .
22 . A revised plan will be submitted to the Planning Board prior
to any Construction for review to insure such plan complies
with this conditional approval .
23. Any work required by the Conservation Commission will be re-
reviewed by the Planning Board for strict compliance with
the conditions of approval .
The granting of said Special Permit will in no way derogate from
the intent and purpose of the North Andover Zoning By Law.

Dear Mr. Long :
The Planning Board held a public hearing on Monday evening,
June 6 , 1983 in the Town Office Meeting Room .upon the appli -
cation of . Rgbert Forget . The hearing was advertised in the
North Andover Citizen on May 13 and 19 , 1983 and all abutters
were notified by certified mail . The following members were
present : Paul A . Hedstrom , Chairman ; Michael P . Roberts ,
Vice Chairman ; Walter R . McDonough,, Clerk; John J . Burke ;
and Erich W, Nitzsche .
The petitioer seeks a Special Permit under Section 4 . 133 ( d )
of the Zoning By Law so as to allow for the alteration of
property to construct two wood frame dwellings and associated
utilities within 100 feet of a tributary to Lake Cochichewick ,
the town ' s water supply . The premises are located and known
as Lot 3 (south side of Dale Street) and Lot 4 (west . side of
Marbleridge ' Road ) .
The engineer representing the applicant testified that :
1 . The applicant is before the Board for the second time due
to a variance denial under Section 4 . 133 (c ) of the Zoning
By Law.
2 . The major revisions reflected on the plans are individual
sewer line connections from each dwelling to Marbleridge
Road v .s . construction_ of a sewer line through the existing
brook and wetland area to the rear of Lots 3 and 4 .
3 . The change in the plan will increase the distance that con -
struction will occur from the wetland , therefore , will mini -
mally impact the environmentally sensitive area .

The site affected is in the R-3 zoning district and consists
of 1 . 7 acres , with frontage totalling 593. 31 feet. The pro-
posed dwellings will have the following dimensions :

The following members were presnt and voting when the Board
rendered their decision on August 29 , 1983 : Paul A. Hedstrom ,
Esq . , Chairman ; Michael P. Roberts , Vice Chairman ; John J .
Burke ; and Erich W . Nitzsche.
Upon a motion made by Mr . Nitzsche and seconded by Mr . Roberts ,
the Board voted to grant the Special Permit subject to the
following conditions :
1 . Only the proposed work shown on the plan entitled "Site
Plan, North Andover , Mass . , prepared for Robert Forget"
by Richard F . Kaminski and Associates , Inc . , dated April
19 , 1985 is permitted under this Special Permit .
2 . The applicant shall provide compensatory storage for any
increased rate of run_-off from the development. Compen-
sating storage cannot be created below the existing 170 .0
foot contour line .
3. All work , including but not limited to the compensating
storage area and the water and sewer lines , shall be com-
pleted in addition to the final loaming and seeding prior
to seeking a building permit .
4 . Upon completion of the final grading of each lot , and prior
to seekjing an occupancy permit, a certified "As Built" plan
from a. Registered Professional Engineer and/or a Registered
Land Surveyor shall be submitted to the Planning Board for
review iof compliance with the SpecialPermitconditions
herein .' Said certification will state that the "As Built"
grading, and construction fully complies to the approved
plan with revisions noted on the plan .
5 . The Conservation Commission ' s Order of Conditions shall be
revieweid by the Planning Board to ensure compliance with
the Sp,e'cial Permit prior to construction on Lots 3 and 4 .
6 . Provide' in satisfactoryform a revised plan for recording

dimensioned ) , including private sewer crossings .

7 . No work will be allowed below the 170 .0 contour line as
it presently exists .
8. Provide invert elevations on the 30 inch drain crossing
Salem Street .
9 . No finish floor will be set lower than elevation 172 .5 ,
10 . A no-cut buffer zone shall exist 25 feet horizontally
from the edge of the existing brook , according to Section
4. 133 (c) of the North Andover Zoning By Law .
11 . A driveway entry permit shall be obtained from the High-
way Surveyor ; whereby the applicant shall consult with
the Highway Surveyor re-garding the location of Lot 4 -
driveway proximity to Salem Street intersection .
12 . The proposed 6 inch raised elevation by both driveways
shall be placed beyond the property line.
13 . Any departure from said plan and/or conditions of approval
shall render this Special Permit null and void.
In granting this Special Permit , the Planning Board finds ,
pursuant to Section 10 . 31 of the Zoning By Law , that :
a ) Lots 3I (Marbleridge Road) and 4 (Salem Street) is the
appropriate location for the construction of the pro -
posed single familyresidential use ;
b ) The applicant ' s request to utilize this land for resi -
dential use will be developed in accordance with the
North Andover Zoning By Law and will not adversely
affect the surrounding neighborhood;
c) In compliance with the conditioned approval , there will
be no nuisance or serious detrimental hazard to vehicles
or pedestrians ;
d ) Adequate and appropriate facilities , inclusive of the town
sewer ;and water connection , will be provided for the proper
and efficient operation of the proposed residential use ;
e ) As a result of approving said Special Permit request , the
Planning Board has therefore determined that the use as
described is in harmony with the general purpose and in-
tent of the Zoning By Law .
