by the Board, and in furtherance thereof hereby agrees to abide by the Board's
Rules and Regulations. The undersigned hereby further covenants and agrees
with the Town of North Andover, upon approval of said DEFINITIVE plan by the
Board:
1. To install utilities in accordance with the rules and regulations of the
Planning Board, the Public Works Department, the Highway Surveyor, the
Board of Health, and all general as well as zoning by=laws of said Town,
as are applicable to the installation of utilities within the limits of
ways and streets;
2. To complete and construct the streets or ways and other improvements shorn
thereon in accordance with Sections Iv and V of the Rules and Regulations'
of the Planning Board and the approved DEFINITIVE plan, 'profiles and cross

The U Farm Subdivision falls under' iiia
category because all of the abutting undeveloped
land is currently owned b,. North Andover
. Associates and is not likely to ever be developed.
Such land will not likely be developed because :
a) most of it is wetlands (see definitive plan
for delination line) and
b) such land is part of complicated land swap
agreement made with the Essex Greenbelt
Society under which the Greenbelt Society
will eventually take title to the land
and keep it undeveloped,
Because of the proximity of this Greenbelt
land and the limited size of the Antonelli
parcel , anything other that a dead end road
would not be practical .
1t is also important to note that. the North Andover
Planning Board is already on record ( in setting
certain conditions on abutting Turner Estates.)

Christian Way into the Antonelli parcel .
Access to Proposed Lots
In responding to this appllv_ant`s initial
Preliminary pian, the Board had expressed some
concern over the applicant's access to a. public
way from the proposed lot=_. . Although we do not
dispute that appropriate access must be
demonstrated, there remains an Issue .as to what
point 4n time the access must be useable . We submit
that actual documentation of access should be
required only as lots ape released for sale or
when a building permit is sought .
First , we !.should like topointout that we have
made several attempts to obtain a formal written
access release from Turner Estates , However,
Mr . Charles Carroll , of that group , refused
to give us such a !.writing and seemed primarily
interested in burying the Antonelli land .at a
bargin basement price ,
Second, we question whether it is proper for the
Board to dery a. definitive plan solely for the
access reason when the below facts are known
to exist ;
1 ) When the Planning Board approved Turner
Estates definitive plan , Vest Way and
Bridges '_ane ,were not approved public
wan, and . et no soecial .access requirement
was imposed upon Turner Estates in order to
get definitive plan approval ,
i) When the Planning Board approved Turner Estates'
definitive plan , in condition #4, It required
an .access easement into The Antonelli land, and
further , the plan itself shows On an easement
punning to Antonelli . This is Confirmed by the
Planning Board meeting minutes of June 16, 1986.
Therefore , once the Turner Estate Subdivision
became nonrevocable ( i .e . when any of the lots
were released) , the Antonelli access easement
became nonre'vocable as a. matter of law. I
believe that the Planning Board has released
some of the lout=_ in the Turner Estate
subdivision . Therefore , the Antonelli ` = have
a legally enforceable access easement across
Christian; flay.
3) Christian Way, as it .approaches the Antonelli
Property , is a road bonded with the town ; a ,
road with the first coat of asphalt down ;
a road on which some lots, 1 believe , have
been released; and a road which , by the
provisions of the Turner Estate definitive
plan , is to be completed by the summer of
1938 and turned over to the Town as a public
way.
`t) Under the 1980 Mass. Appeals Court case of
Richard v , the Planning Board of Acushnet ,
which interpretted the provisions of
M.G.L. ch . 41 s.ec , g+C the court indicated
that the access requirement on a developer
is that either the access road is alread,:
built or that there are assurances ender
M.G.L. ch . til sec . BIU that it will be built .
Such assurances in this case exist by way of
the road bond on Christian Way which was
provided by Turner Estates as part of their
definitive pian .
Finally , it seems most .appropriate , considering all
the factors set forth above , that an approval of the
definitive plan be shade conditional upon the
developer proving such access to the Board approval
before any lots are released . This is what was done
in the Turner Estate definitive plan approval case ,
(condition Q) .

Erosion and sedimentation will be controlled on a permanent
• basis by the re-vegetation of all areas disturbed by
construction . According to the Planning Board Regulations, the
road shoulder will be foamed and seeded. In areas of the
homes, lawns will be planted. For further discussion of
drainage and siltation , see Sections VII and Viil of this
report .

Subsurface conditions that could be a limitation to the
project include high around water . This will effect the
elevation of the foundations of the proposed houses `and septic
systems construction . In areas with a high water table ,
foundations can be constructed so that they are completely
above the ground water level . Septic systems will be raised.

Drainage Analysis
A drainage analysis has been performed to determine the impact that the
developr„ent c it have on the drainage conditions of the surroundinq areas.
When 'a site is developed, the characteristics of the land often change in such
a Way as tc, increase the amount of stormwater runoff that leaves the site.
This anal;.si =_ will determine the extent of the runoff that will leave the site
under pOs.t-a'e.Jelopment conditions, and compare these post-development rates
aJith the rates of runoff that leave the site under existing condition=_..
The drainage analysis performed consists of the Soil Conservation Service
^tethod tc, determine runoff values and a computer model that uses a rainfall
intensity pattern for a 24 Hour atorm ( S.C.B. Type IT Storm) and a unit
hydrogrEph to ;d6velop runoff rates. Calculations were performed to compare
existinn_ arti7 nnst—development conditions for a storm of 100 Year recurrence
?requency .

1 . The Plaintiff resides at 1117 Gatewood Drive in
Alexandria, Virginia and is the owner . of certain real
property located off Christian Way in North Andover ,
Massachusetts as more particularly de.scribed in a deed
recorded in the Essex North Registry of Deeds at Book 350,
Page 462.
2. The Defendant's, Erich W. Nitzsche, John Simons ,
John J. Burke', Paul A. Hedstrome and George Perna are the
members of the Planning Board of the Town of North Andover
and all reside in said town as follows:
Erich w. Nitzsche at 1253 Salem Road
John Simons at 47 Rock Road
John J. Burke at 65 Hillside Road
Paul A. Hedstrome at 30 Oakes Drive
George Perna at 280 Farnum Street
3. On March 18, 1987, the plaintiff caused to be
filed with the Town of North Andover an application for
Preliminary Plan approval (copy attached hereto and
incorporated by reference) together with a preliminary plan
and all other documents required by the Town Subdivision
Regulations.

4. On May 26, 1987, the Defendant Planning Board
voted to disapprove said preliminary plan all as more
specifically set forth in the attached decision. Said
decision was filed with the Town Clerk on May 27, 1987.
5. The Plaintiff is a person aggrieved within the
meaning of Massachusetts General Laws, Chapter 40A, Section
17, by the decision of the Planning Board in denying said
application.
6. The decision of defendant Planning Board violates
the provisions of Section III, A.;-of the Rules and
Regulations Governing the Subdivision of Land in North
Andover and Chapter 40A of the Massachusetts General Laws in
that the application and plan meet all of the requirements of
the state and local regulations.
7. The decision of defendant Planning Board was
arbitrary, unreasonable, and beyond the scope of its
authority in that:
a. The application and accompaning plan met all the
state and local requirements for a preliminary plan
application.
b. Many of the reasons given for the denial do not
even apply as requirements for preliminary plan approval and
are applicable only to definitive plan approval.
C , Other reasons given by the Board for the denial
are blatently wrong and inconsistant with the materials
submitted to the Planning Board .
d. The reason given as #13 inconsistant with prior
Town practices in other approvals given prior to the change
to two acre zoning, and in particular with the approval given
to the adjacent subdivision.
e. Reason#13 of the denial is inconsistant with the
standards of M.G.L. ch. 40A.
f. The real reason this plan was dissapproved,
instead of being approved subject to conditions or
modifications, was that the Town Planning Board was trying to
disqualify this land from being "grandfathered"into one acre
f
zoning instead of the new two acre zoning it would be subject
to if the Plaintiff resubmitted a new plan.
g. The Plaintiff believes that condition #13 of the
dissapproval was used as the excuse for denying this plan and
Was used in a similar fashion to deny other plans of other
applicants similarly situated and before the Board in the
spring of 1987.
h. The Plaintiff believes that the defendants, in
the spring of 1987, created a policy so as to disapprove
numerous subdivision applications, applications that they
would have otherwise appro-ved (based upon their past record)
subject to modification or conditi,bns. Such actions were
Laken in an effort to reduce the number of such subdivisions
as would have otherwise been legally "grandfathered" from the
application of the newly adopted two acre zoning.
WHEREFORE, the Plaintiff requests that the decision
of the North Andover Planning Board in denying Plaintiff 's
application for preliminary plan approval be annulled , and
that this court make an appropriate order so as to cause
approval of the preliminary plan with or without reasonable
conditions. The Plaintiff also requests such further relief
as the court may deem appropriate.

Conditions for Disapproval
1. A request for determination has not been filed with the North Andover
Om*ervatien Cmnission per Section 310 CHR 10.57(4) (b) under Chapter
131 - Wetlands Protection Act, and the local wetlands bylaws and the
definitive plans have not delineated the edge of the boodering
vegetated wetlands.
2. TheHHiigghway Surveyor's reconmendations were not taken into account as
foll-f Cross section shall be submitted with plans.- The curvature of the proposed roadway must be within subdivision
` rules and regulations. The proposed curvature may make it difficult
to maintain.
- Slope granite curbing shall be placed on areas with excess of 5%
grade.
- Manholes at stations 4 and 0 and at end of cul de sac are not
required.
- gutter from road into cul de sac is to be maintained and two catch
basins are to be placed at the end of the cul de sac as to accept
street drainage and cul de sac drainage. Oil de. sac should be
constructed with road crown running through and edges being raised to
direct drainage to basins.
3. The 'Fire Chief's recommerdatiens were not taken into account as
follows:
Fire hydrants are to be installed at 500 foot intervals.
- Lot numbers are to be posted during construction.
- No open burning is to be permitted except during open burning season
under fire department regulations.
- All builders must comply with the fire departments underground fuel
storage regulations. In accordance with the Order od Oxditions of
the NACC item 35, no permits for underground fuel storage will be
issued for lots 6,10, and 11.
- Permanent house numbers shall be posted on dwellings prior to
occupancy-
- Prior to taking occupancy, the subdivision streets shall provide
adequate access to each residence by having the binder cost applied.
- As a matter of public safety and in the best interest of facture
residents of the subdivision, all dwellings should have a residential
sprinkler system installed in acoordance with NEPA 13D and North
Andover Fire Department requirements.
4. Floo4 Hazard, zone from FEM has not: been indicated on plans.
5. A detailed Waiver request for the length of the roadway has not been
submitted for the approval of the Planning Hoard. Request shall
include justification for waiver.

6. UrAtion of proposed houses, septic systems and driveways have not been
shown on grading plan.
7. Drainage calculations have not been submitted to mitigate runoff in the
100 year storm. No calculations or drainage plan has been submitted to
mitigate runoff from the subdivision to the Planning Beard's
satisfaction.
S. No lots shall be released from the covenant running with the property
until the following is completed:
- All drainage is constructed in accordance with the Subdivision Plans,
including binder court application, all utilities, including but not
limited to, fire alarms, water lines, sewer, drainage, electric, gas,

cable shall be installed in accordance with plans.
9. A detailed tree plan in accordance with Secion V, K and IV.1 has not
been submitted with the plan for review by tate Planning Board and the
Tree Warden.
10. A stamp pit burial plan has not been submitted to the planning Board
and Highway Department for review and 'approval prior to any on-site
construction.
11. The applicant shall be advised that in the event a Definitive Plan
evolves from this Preliminary Plan and/or parcel ofland, the North
Andover Planning Board will require upon submittal that all aspects of
the Rules and Regulations governing the Subdivision of land must be
strictly adhered to and will be a requirement notwithstanding this
decision.
12. The applicant has not oomplied with the Tree Department's
reommendation to preserve existing trees and to bond for new planting.

13. The plan, as submitted, does not show adequate access to the proposed
lots. The powers of a planning board (...under) the subdivision
control law shall be exercised with due regard for the provisions of
adequate access to all of the lots in a subdivision by ways that will
be safe and convenient for travel. ..and for coordinating the ways in a
subdivision with each other and with the public ways in the...or Mawr►
in which it is located and with the ways in neighboring subdivisions.
(Chapter 41, Section 81M, M.G.L.) Access must be provided either via an
approved public road or over private ways built to the standards of the
subdivision Rules and Regulations over land to which the developer can
prove he has ownership or right-of-way.
14. A definitive plan submittal shall provide a detailed phasing plan for
the total development. No construction shall occur until the phasing
has been approved by the Planning Hoard. No phasing has been submitted
with the Preliminary Plan.
15. There shall be no common driveways within this subdivision.
16. The police Department recommendations were not taken into account.
