Every application for action by the Board shall be made on a form
approved by the Board. These forms shall be furnished by the
Town Clerk upon request. Any communication purporting to be an
application shall be treated as merenoticeof intention to seek
relief until such time as it is made on the official application
form. ; All information called for by the form shall be furnished
by the applicant in the manner therein prescribed in accordance
with the requirements of Section 8. 3 .

The Board of Appeals held a regular meeting on Tuesday, March 9,
1993 upon the application of Frank Marino of the Brooks School
requesting a variation of Section 7, Paragraph 7.4 and Table 2 of
the Zoning Bylaw so as to permit relief of twenty (20) feet, from
the bylaw height requirements, for the height of two buildings, a
new library to be constructed and a second building called the
Link, on the premises located at 1160 Great Pond Road. The
following members were present and voting: Frank Serio, Jr. ,
Chairman, Walter Soule, Clerk, Raymond Vivenzio, Louis Rissin and
John Pallone.
The hearing was advertised in the North Andover Citizen on
February 17 and 24, 1993 and all abutters were notified by
regular mail.
Upon a motion by Mr.Rissin and second by Mr. Pallone, the Board
voted unanimously to GRANT the variance as requested.
The Board finds that the granting of this variance will not
adversely affect the neighborhood or derogate from the intent and
purpose of the Zoning Bylaw.

Therefore, the North Andover Conservation Commission (hereafter
the "NACC") hereby finds that the following conditions are
necessary, in accordance with the Performance Standards set forth
in the State Regulations, the local ByLaw and Regulations, to
protect those interests noted above. The NACC orders that all
work shall be performed in accordance with said conditions and ,
with the Notice of Intent referenced above. To the extent that
the following conditions modify or differ from the plans,
specifications or other proposals submitted with the Notice of
Intent, the conditions shall control.
GEN ML CONDITIONS
1. Failure to comply with all conditions stated herein, and with
all related statutes and other regulatory measures, shall be
deemed cause to revoke or modify this Order.
2. This Order does not grant any property rights or any
exclusive privileges; it does not authorize any injury to
private property or invasion of private rights.
3 . This Order does not relieve the permittee or any other person
of the necessity of complying with all other applicable federal,
state or local statutes, ordinances, by-laws or regulations.
4. The work authorized hereunder shall be completed within three
years from the date of this Order.
5. This Order may be extended by the issuing authority for one
or ,more periods of up to one year each upon application to the
issuing authority at least 30 days prior to the expiration date
of the Order.
6. where the Department of Environmental Protection is requested
to make a determination and to issue a Superseding Order, the
Conservation Commission shall be a party to all agency
proceedings and hearings before the Department.
7. The proposed work includes sewer system.
8. The work shall conform to the following (except as noted in
the remainder of this document where revisions may be required) :
(a) Notice of Intent filed by Fay, Spofford & Thorndike, Inc.
(b) Plans prepared by Fay, Spofford & Thorndike,, Inc.
9. The following wetland resource areas are affected by the
proposed work: buffer zone. These resource areas are significant
to the interests of the Act and Town Bylaw as noted above. These
resource areas are also significant to the recreational and

wildlife interests of the Bylaw. The applicant has not attempted
to overcome the presumption of significance of these resource
areas to the identified interests.
10. The NACC agrees with the applicant's delineation of the
wetland resource areas on the site as shown on the plans.
11. Issuance of these Conditions does not in any way imply or
certify that the site or downstream areas will not be subject to
flooding or storm damage.
12 . The conditions of this decision shall apply to, and be
binding upon, the applicant, owner, its employees and all
successors and assigns in interest or control.
13 . All catch basins shall contain oil/gasoline traps, and it
shall be a continuing condition of this order, even after a
Certificate of Compliance is issued, that the oil/gasoline traps
in the catch basins be maintained. All catch basins shall be
free of all accumulated silt and debris before a Compliance is
issued and the owner or his/her agent shall so specify in the
request for a Compliance.
14. The sewer lines on the site, where they cross wetland
resource areas, shall be tested for water tightness in accordance
with North Andover DPW standards.'
PRIPR TO CONSTRUCTION
15. No work shall be undertaken until all administrative appeal
periods from this Order have elapsed or, if such an appeal has
been; filed, until all proceedings before the Department or Court
have been completed.
16. This Order shall be recorded by the applicant at the
Registry of Deeds immediately after the expiration of all appeal
periods. No work shall be undertaken until the Final Order has
been recorded in the Registry of Deeds or the Land Court for the
district in which the land is located, within the chain of title
of the affected property. In the case of recorded land, the
Final Order shall also be noted in the Registry' s Grantor Index
under the name of the owner of the land upon which the proposed
work is to be done. In the case of registered land, the Final
Order shall also be noted on the Land Court Certificate of Title
of the owner of the land upon which the. proposed work is to be
done. The recording information shall be submitted to the North
Andover Conservation Commission on the form at the end of this
Order prior to commencement of the work.
17. , A sign shall be displayed at the site not less than two
square feet or more than three square feet in size bearing the
words, "Massachusetts Department of Environmental Protection,

18. Any changes in the submitted plans caused by the applicant,
another Board's decision or resulting from this order of
Conditions must be submitted to the NACC for approval prior to
implementation. If the NACC finds said changes to be
significant, the NACC will call for another public hearing (at
the expense of the applicant) . Within 21 days of the close of
said public hearing the NACC will issue an amended or new Order
of conditions. Any errors found in the plans or information
submitted by the applicant shall be considered as changes. The
proposed project may be still under review by other local or
state boards or agencies. This may result in changes to the
project plans or wetland impacts. If any such changes occur a
revised plan and an explanation of the revisions shall be
submitted to the NACC for review and approval prior to the start
of construction. No work shall begin on a project until written
approval has been granted by the NACC.
19. The applicant shall contact the Conservation Office prior to
site preparation or construction and shall arrange an on-site
conference with an NACC representative, the contractor and the
applicant to ensure that all of the Conditions of this Order are
understood. This Order also shall be made a part of the
contractor's written contract. The applicant or contractor shall
notify the NACC in writing of the identity of the on-site
construction supervisor hired to coordinate construction and to
ensure compliance with this Order.
20. Wetland flagging shall be checked prior to start of
construction and shall be re-established where missing so that
erosion control measures can be properly placed and wetland
impacts can be monitored.
21. A row of staked hay bales backed by a siltation fence shall
beplacedbetween all construction areas and wetlands. The
erosion control barrier will be properly installed and placed as
indicated on plan and shall be inspected and approved by the NACC
prior to the start of construction and shall remain intact until
all 'disturbed areas have been permanently stabilized to prevent
erosion. All erosion prevention and sedimentation protection
measures found necessary during construction shall be implemented
atthedirection of the NACC.
22 . The applicant shall have on hand at the start of any soil
disturbance, removal or stockpiling, a minimum of fifty (50) hay
bales and sufficient stakes for staking these bales (or an
equivalent amount of silt fence) . Said bales shall be used only
for the control of emergency erosion problems, and shall not be
used for the normal control of erosion.
23. A proper bond or a deposit of money running to the Town of

North Andover shall be provided in the amount of $1,000. 00 which
shall) be in all respects satisfactory to Town Counsel, Town
Treasurer, and the NACC, and shall be posted with the North
Andover Town Treasurer before commencement of work. Said bond or
deposit of money shall be conditioned on the completion of all
conditions hereof, shall be signed by a party or parties
satisfactory to the NACC, and Town Counsel, and shall be released
after completion of the project, provided that provision,
satisfactory to the NACC, has been made for performance of any
conditions which are of continuing nature. The applicant may
propose a bond release schedule keyed to completion of specific
portions of the project for the NACC's review and approval. This
condition is issued under the authority of the local Bylaw.
DURING CONSTRUCTION
24. Any fill used in connection with this project shall be clean
fill, containing no trash, refuse rubbish or debris, including
but not limited to lumber, bricks, plaster, wire, lath, paper,
cardboard, pipe, tires, ashes, refrigerators, motor vehicles or
parts of any of the foregoing.
25. No exposed area shall remain unfinished for more than thirty
(30) days, unless approved by the NACC.
26. No regrading in the buffer zone shall have a slope steeper
than 2: 1 (horizontal:vertical) . Slopes of steeper grade shall be
rip-rapped to provide permanent stabilization.
27 . There shall be no stockpiling of soil or other materials
within twenty-five (25) feet of any resource area.
28. 'Washings from concrete trucks, or surplus concrete, shall not
be directed to, any drainage system or wetland resource area.
29. All waste generated by, or associated with, the construction
activity shall be contained within the construction area, and
away from any wetland resource area. There shall be no burying
of spent construction materials or disposal of waste on the site
by any other means. The applicant shall maintain dumpsters (or
other suitable means) at the site for the storage and removal of
such spent construction materials off-site.
30. Accepted engineering and construction standards and
procedures shall be followed in the completion of the project.
j31. Members of the NACC or its agent shall have the right to
enter upon and inspect the premises to evaluate and/or effect
compliance with this Order of Conditions. The NACC reserves the
right to require, following field inspection, additional
information or resource protection measures.

3Z. During and after work on this project, there shall be no
discharge or spillage of fuel, or other pollutants into
any, wetland resource area. If there is a spill or discharge of
any, pollutant during any phase of construction the NACC shall be
notified by the applicant within one (1) business day. No
construction vehicles are to be stored within 100 feet of wetland
resource areas, and no vehicle refueling, equipment lubrication,
or maintenance is to be done within 100 feet of a resource area.
AFTER CONSTRUCTION
33. No underground storage of fuel oils shall be allowed on any
lot within one-hundred (100) feet of any wetland resource area.
This Condition shall survive this Order of Conditions, and shall
run with the title of the property. This condition is issued
under the authority of the Town's Wetland Protection ByLaw.
34. Fertilizers utilized for landscaping and lawn care shall be
organic and low-nitrogen content, and shall be used in
moderation. Pesticides and herbicides shall not be used within
100 'feet of a wetland resource area. This condition is issued
under the authority of the Town's Wetland Protection ByLaw.
35. 'Upon completion of construction and grading, all disturbed
areas located outside resource areas shall be stabilized
permanently against erosion. This shall be done either by
loaZing and seeding according to SCS standards. If the latter
course is chosen, stabilization will be considered complete once
vegetative cover has been achieved.
37. ' The following special conditions shall survive the issuance
of a Certificate of Compliance for this project:
32 . Discharge or spillage of pollutants.
33 . Prohibition of storage of fuels underground.
34. Limitations on the use of fertilizers, herbicides
and pesticides.

Therefore, the North Andover Conservation Commission (hereafter
the "NACC°) hereby finds that the following conditions are
necessary, in accordance with the Performance Standards set forth
in the State Regulations, the local ByLaw and Regulations, to
protect those interests noted above. The NACC orders that all
work 'shall be performed in accordance with said conditions and ,
with the Notice of Intent referenced above. To the extent that
the following conditions modify or differ from the plans,
specifications or other proposals submitted with the Notice of
Intent, the conditions shall control.
GENRU CONDITIONS
1. Failure to comply with all conditions stated herein, and with
all related statutes and other regulatory measures, shall be
deemed cause to revoke or modify this Order.
2 . This Order does not grant any property rights or any
exclusive privileges; it does not authorize any injury to
private property or invasion of private rights.
3 . This Order does not relieve the permittee or any other person
of the necessity of complying with all other applicable federal,
state or local statutes, ordinances, by-laws or regulations.
4 . The work authorized hereunder shall be completed within three
years from the date of this Order.
5. This Order may be extended by the issuing authority for one
or more periods of up to one year each upon application to the
issuing authority at least 30 days prior to the expiration date
of the Order.
6. Where the Department of Environmental Protection is requested
to make a determination and to issue a Superseding Order, the
Conservation Commission shall be a party to all agency
proceedings and hearings before the Department.
7 . The proposed work includes sewer system.
8. The work shall conform to the following (except as noted in
the remainder of this document where revisions may be required) :
(a) Notice of Intent filed by Fay, Spofford & Thorndike, Inc.
(b) ,'Plans prepared by Fay, spofford & Thorndike, Inc.
9 . the following wetland resource areas are affected by the
proposed work: buffer zone. These resource areas are significant
to the interests of the Act and Town Bylaw as noted above. These
resource areas are also significant to the recreational and

wildlife interests of the Bylaw. The applicant has not attempted
to overcome the presumption of significance of these resource
areas to the identified interests.
10. The NACC agrees with the applicant's delineation of the j
wetland resource areas on the site as shown on the plans.
11. Issuance of these Conditions does not in any way imply or
certify that the site or downstream areas will not be subject to
flooding or storm damage.
12 . The conditions of this decision shall apply to, and be
binding upon, the applicant, owner, its employees and all
successors and assigns in interest or control.
13 . All catch basins shall contain oil/gasoline traps, and it
shall be a continuing condition of this order, even after a
Certificate of Compliance is issued, that the oil/gasoline traps
in the catch basins be maintained. All catch basins shall be
free of all accumulated silt and debris before a Compliance is
issued and the owner or his/her agent shall so specify in the
request for a Compliance.
14 . The sewer lines on the site, where they cross wetland
resource areas, shall be tested for water tightness in accordance
with North Andover DPW standards.'
PRIOR TO CONSTRUCTION
15. No work shall be undertaken until all administrative appeal
periods from this Order have elapsed or, if such an appeal has
been filed, until all proceedings before the Department or Court
have been completed.
16. This Order shall be recorded by the applicant at the
Registry of Deeds immediately after the expiration of all appeal
periods. No work shall be undertaken until the Final Order has
beenrecorded in the Registry of Deeds or the Land Court for the
district in which the land is located, within the chain of title
of the affected property. In the case of recorded land, the
Final Order shall also be noted in the Registry's Grantor Index
under the name of the owner of the land upon which the proposed
world is to be done. In the case of registered land, the Final
Order shall also be noted on the Land Court Certificate of Title
of the owner of the land upon which theproposed work is to be
done. The recording information shall be submitted to the North
Andover Conservation Commission on the form at the end of this
order prior to commencement of the work.
17. A sign shall be displayed at the site not less than two
square feet or more than three square feet in size bearing the
words, "Massachusetts Department of Environmental Protection,

File Number 242-655" .
18. Any changes in the submitted plans caused by the applicant,
another Board's decision or resulting from this Order of
Conditions must be submitted to the NACC for approval prior to
implementation. If the NACC finds said changes to be
significant, the NACC will call for another public hearing (at
the expense of the applicant) . Within 21 days of the close of
said public hearing the NACC will issue an amended or new Order
of Conditions. Any errors found in the plans or information
submitted by the applicant shall be considered as changes. The
proposed project may be still under review by other local or
state boards or agencies. This may result in changes to the
project plans or wetland impacts. If any such changes occur a
revised plan and an explanation of the revisions shall be
submitted to the NACC for review and approval prior to the start
of construction. No work shall begin on a project until written
approval has been granted by the NACC.
19. The applicant shall contact the Conservation Office prior to
site preparation or construction and shall arrange an on-site
conference with an NACC representative, the contractor and the
applicant to ensure that all of the Conditions of this Order are
understood. This Order also shall be made a part of the
contractor's written contract. The applicant or contractor shall
notify the NACC in writing of the identity of the on-site
construction supervisor hired to coordinate construction and to
ensure compliance with this order.
20. Wetland flagging shall be checked prior to start of
construction and shall be re-established where missing so that
erosion control measures can be properly placed and wetland
impacts can be monitored.
21. A row of staked hay bales backed by a siltation fence shall
be placed between all construction areas and wetlands. The
erosion control barrier will be properly installed and placed as
indicated on plan and shall be inspected and approved by the NACC
prior to the start of construction and shall remain intact until
all disturbed areas have been permanently stabilized to prevent
erosion. All erosion prevention and sedimentation protection
measures found necessary during construction shall be implemented
at the direction of the NACC.
22. The applicant shall have on hand atthe start of any soil
disturbance, removal or stockpiling, a minimum of fifty (50) hay
bales and sufficient stakes for staking these bales (or an
equivalent amount of silt fence) . Said bales shall be used only
for the control of emergency erosion problems, and shall not be
used for the normal control of erosion.
23 . A proper bond or a deposit of money running to the Town of

North Andover shall be provided in the amount of $1,000.00 which
shall be in all respects satisfactory to Town Counsel, Town
Treasurer, and the NACC, and shall be posted with the North
Andover Town Treasurer before commencement of work. Said bond or
deposit of money shall be conditioned on the completion of all
conditions hereof, shall be signed by a party or parties
satisfactory to the NACC, and Town Counsel, and shall be released
after completion of the project, provided that provision,
satisfactory to the NACC, has been made for performance of any
conditions which are of continuing nature. The applicant may
propose a bond release schedule keyed to completion of specific
portions of the project for the NACC' s review and approval. This
condition is issued under the authority of the local Bylaw.
DURING CONSTRUCTION
24 . Any fill used in connection with this project shall be clean
fill, containing no trash, refuse rubbish or debris, including
but not limited to lumber, bricks, plaster, wire, lath, paper,
cardboard, pipe, tires, ashes, refrigerators, motor vehicles or
parts of any of the foregoing.
25. No exposed area shall remain unfinished for more than thirty
(30) days, unless approved by the NACC.
26. No regrading in the buffer zone shall have a slope steeper
than 2: 1 (horizontal:vertical) . Slopes of steeper grade shall be
rip-rapped to provide permanent stabilization.
27 . There shall be no stockpiling of soil or other materials
within twenty-five (25) feet of any resource area.
28. Washings from concrete trucks, or surplus concrete, shall not
be directed to, any drainage system or wetland resource area.
29. All waste generated by, or associated with, the construction
activity shall be contained within the construction area, and
away from any wetland resource area. There shall be no burying
of spent construction materials or disposal of waste on the site
by any other means. The applicant shall maintain dumpsters (or
other suitable means) at the site for the storage and removal of
such spent construction materials off-site.
30. Accepted engineering and construction standards and
procedures shall be followed in the completion of the project.
31. Members of the NACC or its agent shall have the right to
enter upon and inspect the premises to evaluate and/or effect
compliance with this Order of Conditions. The NACC reserves the
right to require, following field inspection, additional
information or resource'protection measures.

32. During and after work on this project, there shall be no -
discharge or spillage of fuel, or other pollutants into
any w6tland resource area. If there is a spill or discharge of
any pollutant during any phase of construction the NACC shall be
notified by the applicant within one (1) business day. No
construction vehicles are to be stored within 100 feet of wetland
resource areas, and no vehicle refueling, equipment lubrication,
or maintenance is to be done within 100 feet of a resource area.
AFTRR; CONSTRUCTION
33 . NO underground storage of fuel oils shall be allowed on any
lot within one-hundred (100) feet of any .wetland resource area.
This Condition shall survive this Order of Conditions, and shall
run with the title of the property. This condition is issued
under the authority of the Town' s Wetland Protection ByLaw.
34. Fertilizers utilized for landscaping and lawn care shall be
organic and low-nitrogen content, and shall be used in
moderation. Pesticides and herbicides shall not be used within
100 feet of a wetland resource area. This condition is issued
under the authority of the Town's Wetland Protection ByLaw.
35. Upon completion of construction and grading, all disturbed
areas located outside resource areas shall be stabilized
permanently against erosion. This shall be done either by
loaming and seeding according to SCS standards. If the latter
course is chosen, stabilization will be considered complete once
vegetative cover has been achieved.
37. The following special conditions shall survive the issuance
of a' Certificate of Compliance for this project:
32 . Discharge or spillage of pollutants.
33 . Prohibition of storage of fuels underground.
34 . Limitations on the use of fertilizers, herbicides
and pesticides.

Dear Mr. Long:
The North Andover Planning Board held a public hearing on June
29, 1993 in the Senior Center behind the Town Building upon the
application of Brooks School, requesting site plan approval under
Section 8. 3 of the North Andover Zoning Bylaw. The legal notice
was published in the Lawrence Eagle Tribune on June 14 and June 21,
1993 and all parties of interest were properly notified. The
following members were present: John Simons, Acting Chairman,
Joseph Mahoney, Clerk, Richard Rowen, John Draper and George Perna,
Associate Member.
The petitioner was requesting site plan approval for the
construction of a new library and business office for a total of
30, 133 sq. ft. The premises affected is located at 1160 Great Pond
Road, in a Residential-1 (R-1) Zoning District.
Representing Brooks School at the meeting were Tom Amsler,
Kevin Burke, Bruce Norelius and Frank Marino.
Mr. Mahoney read the legal notice to open the public hearing.
Ms. Bradley gave the Board an overview of the Technical Review
Committee meetings.
Proposed:

Mr. Simons asked how close the building was from the wetlands.
The answer was "greater than 600 feet" . The only work in the
buffer zone is to plug the ends of the pipe. A special permit may
be needed to excavate in the wetland area and buffer zone to plug
existing pipe and clear old drain.
Mr. Mahoney asked if there were parking issues. The proposed
building would not increase school population or traffic but a new
driveway would be created out to the lake. No traffic would go
through, the center of campus, pedestrian way in the future. There
would be a net gain of 3 parking spaces.
Mr. Marino expressed concern about speed of cars through the
center of campus, safety concerns.
Mr. Perna asked where the mechanicals for the building would
be. The answer was "air conditioning sunk into wall, there would
be no roof top equipment".
Landscape Site Plan:
Trees with black dots are existing trees, low maintenance
landscaping, grassed terrace with flower bed above the building
office.
Lights shown on the plans as black dots with yellow
highlighting. The applicants would like to continue concept of
lighting entrance - inviting people in.
Mr. Draper asked if there was any potential for neighbors to
view the lights. The answer was "no" . Mr. Draper asked if there
was handicap access and parking. The reply was "yes".
Mr. Draper asked why the need for trucks. The business office
will be used for receiving and shipping for school as well as mail
and the bookstore.
Mr. Draper asked about the time-frame for construction.
Ground breaking is expected November 1, 1993 . The site needs to be
prepared for digging. This work needs to be started this summer.
On a motion by Mr. Rowen, seconded by Mr. Draper, the Board
voted to close the public hearing.
The Board members will take individual site visits.
A 'draft decision will be available for the Board to review at
the neat meeting.

The following members were present: Richard Nardella, Chairman,
Joseph,' Mahoney, Clerk, Richard Rowen, and John Draper.
On a motion by Mr. Draper, seconded by Mr. Rowen the Board
voted to approve the plans and conditional approval for Brooks
School.'

Site Plan Review Conditional Approval
The planning Board makes the following findings regarding this
Site ', Plan Review for the construction of a new library and
business office for a total of 30, 133 square feet of new
construction, as required bby Section 8.3 of the Zoning Bylaw.
FINDINGS OF FACT:
1. The proposed use and site design for this lot are
appropriate as it is on the Brooks School site.
2. Adequate vehicular and pedestrian access into the site has
been provided with the adherence to the approved plans.
3. The plan as shown and revised, meets the requirements of
section 8 .4 of the Zoning Bylaws, with the addition of the
enclosed conditions.
4. The site drainage system is designed in accordance with the
Town Bylaw requirements.
5. The applicant has met the requirements of the Town for Site
Plan Review as stated in Section 8.3 of the Zoning Bylaw.
6. Adequate and appropriate facilities will be provided for the
proper operation of the proposed use.
Finally, the Planning Board finds that this modification
generally complies with the Town of North Andover Zoning Bylaw
requirements as listed in section 8.35 but requires conditions in
order to be fully in compliance.
Therefore, in order to fully comply with the approval necessary
to construct the facility as specified in the Site Plan Review
application before us, the Planning Board hereby grants an
approval to the applicant provided the following conditions are
met:
SPECIAL CONDITIONS:
1. Prior to any construction:
a. The final plans must be reviewed by the Town Planner.
b. The Town Planner and/or the Tree Warden must be
contacted prior to any cutting and/or removal
vegetation on-site. The Planner and/or Tree Warden
will walk the site with the applicant to identify any
trees and/or vegetation that may be preserved.
C. A bond in the amount of $5000. 00 shall be posted for
the purpose of insuring that a final As-Built plan
showing location of all on site utilities, structures,
curb cuts, parking spaces and drainage facilities be
submitted. This bond shall be in the form of a check
made out to the Town of North Andover. This check will
then be deposited into an interest bearing escrow
account. (FORM G is available in the Planning office)
2. Prior to FORM U verification (Building Permit Issuance) :
a. This decision shall be recorded at the Essex North
Registry of Deeds and a recorded copy delivered to the
Planning Staff.
b. The applicant shall place erosion control measures on
site as directed by the Town Planner.
C. The North Andover Division of Public Works shall
approve all plans. Any changes to the plans approved by
the Planning Board shall be reviewed by the Town
Planner. Any changes which the Town Planner may deem as
major shall be approved by the Planning Board.
3 . Prior to verification of the Certificate of Occupancy:
a. The building shall have fire sprinklers installed per
order of the North Andover Fire Department.
b. The site shall be reviewed by the Planning Staff. Any
screening as may be reasonably required by the Planning
Staff and/or Tree Warden will be added at the
applicant's expense.
C. A final as-built showing the location of all on site
utilities, structures, curb cuts, parking spaces and
drainage facilities must be submitted to and approved
by the Division of Public Works.
d. All Lighting shall be as shown on the Site Plan.
4. Any Plants, Trees or Shrubs that have been incorporated
into the Site Plan approved in this decision, that die
within one year from the date of this approval, shall be
replaced by the owner.
5. The contractor shall contact Dig Safe at least 72 hours
prior to commencing any excavation.
6. Gas, Telephone, Cable and Electric utilities shall be
installed as specified by the respective utility companies.
7. All catch basins shall be protected and maintained with hay
bales to prevent siltation into the drain lines during
construction.
8. No open burning shall be done except as is permitted during
burning season under the Fire Department regulations.
9. No underground fuel storage shall be installed except as may
be allowed by Town Regulations.
10. No mechanical devices (ie: HVAC, vents, etc. . . ) which may be
visible from any surrounding roadways shall be placed on the
roof.
11. The provisions of this conditional approval shall apply to
and be binding upon the applicant, it's employees and all
successors and assigns in interest or control.

A public hearing was held by the Board of Appeals on April 9, 1979 upon application
of Brooks School who requested a variation of Sec. 7.4 and Table 2 of the Zoning
By-Law so as to permit a variance from the height requirements for buildings located
in residence districts located at 1160 Great Pond Rd. and shown on a plan of land
dated March 28, 1979. The following members were present and voting: Alfred E.
Frizelle, Vice-Chairman; R. Louis DiFruscio, Clerk; James D. Noble, Jr.; Richard J.
Trepanier; and William J. Sullivan, Assoc. Member,
The hearing was advertised in the North Andover Citizen on March 22 & 29, 1979 and
all abutters were duly notified by regular mail.
John Kirchner, Carlson Corp. , represented Brooks School and stated that they would
like to expand their existing gym facilities for new locker space. He presented a
site plan of the expansion as proposed and floor plans. They are requesting a height
variance to about 40+ ft. which is approximately 5z ft. in excess of what is allowed
under the By-Law-and roughly 3 ft. higher than the existing building they are tying
into.
There was no opposition.
Mr. DiFruscio made a motion to GRANT the variance based upon the following principle
points: the proposed gymnasium a locker room facilities addition to the Danforth
Auditorium complex shall exceed by 5'8" in Phase I and 7'8" in Phase II those height
restrictions as set forth in Table 2 of the Zoning By-Law for the Town of North
Andover. The existing facilities range in height from 38 ft. (Danforth Bldg.) to
approximately 55 ft. (Auditorium) above existing grade. In order to maintain the

visual continuity of design and achieve the height clearances for which the space is
intended, a high 40'8" above the entry finish floor to the top of structure is required.
The design is dictated by existing building and utilities, existing contours, possible
future need for material storage if energy requirements necessitate conversion of the
present oil fired main steam plant to coal, a continuing desire to maintain the open-
ness and natural beauty of the area, and utilitarian relationships to existing
facilities, Those uses included are required to expand and replace existing support
facilities for the Brooks School athletic and academic curriculums. The facility
utilization shall be consistent with those of the surrounding structures and is not
intended to generate an increase in traffic and/or any other condition which would be
detrimental to the surrounding neighborhood. Mr. Trepanier seconded the motion and
the vote was unanimous.

PLAN OF LAND TO ACCOMPANY PETITION
Each application and petition to the Board shall be accompanied by
; j five (5) copies of the following described plan:

i The size of the plan shall be 11 x 17, drawn to scale, 1 inch
equals 40 feet; it shall have a north point, names of streets,
zoning districts, names and addresses of owners of*,properties
within a minimum of 200 feet of the subject property, property
Lines and location of buildings on surrounding properties. The
location of buildings or use of the property where a variance is
requested and distances from adjacent buildings and property Lines
shalt be verified in the field and shown on the plan. The
dimensions of the lot and the percentage of the lot covered by the
principal and accessory buildings and the required parking spaces
shall be shown. Entrances, exits, driveways, etc. that are
a pertinent to the granting of the variance shall be shown. All
proposed data shall be shown in red.
Any topographical feature of the parcel of land relied upon for a
variance, such as ledge, rock peat, or natural condition of water,
brook, or river, shall be shown on the engineering plan. When a
variance is requested to subdivide a parcel. of land, the dimen-
sions and area,of. the surrounding lots may be taken fzom the deed
or lotting plan for comparison of the size of the Lots in the
neighborhood, noted on the plan as such, and marked "approximate".
The plan shalt be signed and bear the seat of a registered
surveyor or engineer. Any plans presented with the petition shall
remain a part of the records of the Board of Appeals.
If living quarters are to be remodeled, or areas are to be
converted into living quarters, in addition-to the plot plan, five
(5) copies of the following described plans shall be furnished:
1. A floor plan of each floor on which remodeling is to be done
or areas converted into living quarters;
2. A floor plan showing the stairways, halls, doors opening into
the halls, and exit doors of each floor or floors where no re-
modeling or converting is to be done;

proposed work shalt be shown in red. The size of. each plan
shall be it x 17 or 17 x 22; it shall be drawn to scale, 1/4

The Board of Appeals held a public hearing on Tuesday evening, August 14, 1990
upon the application of Brooks School requesting a Special Permit from the
requirements of Section 5, Paragraph 6 of the Zoning Bylaw so as to permit earth
removal for construction of athletic fields and pond for use in irrigating said
fields on the premises located at 1160 Great Pond Road. The following members
were present and voting: Frank Serio, Jr., Chairman, Walter Soule, Clerk, Raymond
Vivenzio, Anna O'Connor and Louis Riasin.
The hearing was advertised in the North Andover Citizen on June 27, 1990 and
July 3, 1990 and all abutters were notified by regular mail
Upon a motion made by Mr. Rissin and seconded by Mr. Soule, the Board voted,
unanimously, to GRANT the Special Permit, provided the petitioner follow all
the conditions asked for by the North Andover Conservation Commission.
The Board finds that the granting of this Special Permit will not adversely
affect the neighborhood or derogate from the intent and purpose of the
Zoning Bylaw.

The Board of Appeals held a Special Meeting on Monday evening, December 17, 1990
continued from December 11, 1990 upon the application of Harry Manzi requesting a
Special Permit modification from the requirements of Section 5.5, Paragraph 2 of
the Zoning Bylaws so as to permit the removal of 22,000 cu. yds. off Lot 25 ,
Coventry ,Lane. This would make a 25' setback now instead of the original 50'
granted by petition 88-89 issued on February 13, 1990. The following members
were present and voting: William Sullivan, Vice-chairman, Walter Soule, Clerk,
Raymond Vivnezio and Anna O'Connor.
The hearing was advertised in the Lawrence Eagle Tribune on November 26, 1990
and December 3, 1990 and all abutters were notified by regular mail.
Upon a motion made by Mr. Vivenzio and seconded by Mr. Soule, the Board voted,
unanimously, to GRANT the Special Permit modification in accordance with the
plans dated December 14, 1990 showing a 25' setback replacing original 50' set-
back for,rear lot line, subject to the following conditions:
1. Soil erosion controls be installed on the rear slope in
accordance with the requirements of the Building Inspector
and North Andover Conservation Administrator, within 30
(thirty) days.
2. Felled trees at the top of the slope are to be removed
from the property within thirty (30) days.

** The principal points upon which I base my application are as follows:
The proposed gymnasium and locker room facilities addition to the
Danforth/Auditorium complex shall exceed by 5'-8" in Phase I and
P-8" in Phase II those height restrictions as set forth in Table 2
of the Zoning By-Laws for the Town of North Andover. The existing
facilities range in height from 38 feet (Danforth Building) to
approximately 55 feet (Auditorium) above existing grade. In order to
maintain the visual continuity of design and achieve the height
clearances for which the space is intended, a high of 40'-8" above the
entry finish floor to the top of structure is required (see attached
exhibits). The design is dictated by existing building and utilities,
existing contours, possible future need for material storage if energy
requirements necessitate conversion of the present oil fired main steam
plant to coat , a continuing desire to maintain the openness and natural
beauty of the area, and utilitarian relationships to existing facilities.
Those uses included are required to expand and replace existing support
facilities for the Brooks School athletic and academic curriculums.
The facility utilization shall be consistent with those of the
surrounding structures and is not intended to generate an increase
in traffic and/or any other condition which would be detrimental to
the surrounding neighborhood.
