Lyons, Town Clerk Town Building North Andover, Mass. Dean Sirs The fallowing petition was heard at a meeting of the Planning Board on . Monday evening, March 5, 1962 at the Town Office Building. The decision was made on March 8, 1962. Members present and voting were: James M. Bannan, Chairman; Robert J. Burke, Secretary; Howard L. Gilman, George Farley and William Chepulis, Jr, John Parnum petitioned to amend the North Andover Zoning by-Law by changing from Rural Residential to General Business a parcel of land on Turnpike and Johnson Streets. This is a triangular parcel with an area of approx. 6,000 sq. feet. Atty. John Lynch represented the petitioner. There were approximately 10 pa<pple present at the hearing. Five abutters were recorded as opposed. Three were recorded in favor. At the Planning Board meeting on March 8, 1962, the board voted on the petdtion. Mr. Burke made a motion to DENY the petition and Mr. Farley seconded the motion. The vete was unanimous. The reason for denial is that the parcel of land does not comply with the North Andover Zoning By-law land area requirements. Very truly yours, PLANNING BOARD James M. Lyons, Town Clerk Town Buildigg N. Andover, Mass. Dear sir: The following petition was heard at a meeting of the Planning Board on Monday evening, February 17, 1964 at the Town Office Building. Members present and voting were:; James M. Barmen, Cbairman; Robert J. Burke, Secretary; Hovard Gillman, George Farley and William Chepulis. JOHN C. FARM petitioned to amend the North Andover Zoning By Law by changing from Rural Residence to General Business, two parcels of lana. on Turnpike Street; one parcel now contains the Ski Tow and the other parcel is directly across the street, both contain approx. 33 acres each. Atty. Charles W. Trombly represented the petitioner, who was present. Robert Dunn, Manager of the Boston 8311 Ski Tow was also present. It is proposed to have an 18-hole Golf Course on the area across the street from the Ski Tow. They would ,like to have a year-round recreational areas. There were appr©x, 20 people present. Several of the abutters were opposed to re-ronin$ the area to business, but were not opposed to the golf course, as planned. Ethers present just questioned the petitioners. Two immediate abutters were not opposed. Mr. Burke made a motion to approve the re-zoning. Mr. Gilman seconded the motion. Members Burke, Gi2mn, Farley and. Chepulis in favor. 2hairman Bannon voted Pio because he did not believe the present Business Zoning Law is sufficiently restrictive. Reasons for approval area 1. Dear Sir: The following petition was heard at a sleeting of the Planning Board an Monday evening, February 25, 1963 at the Town Office Building. Mr. Chepulis was unable to attend the meeting. John J. Willis petitioned to amend the Horth Andover Zoning By-Law by changing from Rural Residential to General Business a parcel of land on Turnpike and Johnson Streeter, containing approx. 12 acres. The petitioner presented his case. There were apprazimately 20 people present for the hearings of the evening. There was no opposition recorded. At the Planning Board meeting on March l+, 1963s, the Hoard voted on the petition. Mr. Burke made a motion to APPEOVE the petition, seconded by Mr. Gilman. The vote was uneumous. The reasons for approval are as followas 1. The parcel of land is on a heavily travelled highway that does not lend itself to residential ',development. 2. It is directly across the street from a conmercial operation which has been going on for many years. 3. There is a great need for business locations in this town in areas which have not yet been built up with homes and such is the case with this location. Dear Sir: The following petition was heard at a meeting of the Board of Appeals on Monday evening, September 16, 1963 at the Town Office Building. Members present and voting were: Daniel T. O'Leary, Chairman; William Morton, Secretary; John J. Shields, Arthur Drummond and Robert J. Burke, Associate Member, who sat in place of Henry E. Lund. JOW C. FARCIUM & BOSTON SKI DEVEIAEWT CORPORATION requested a variation of Sec. 42 Para. 4.04 of the Zoning By-Lav so as to permit the erection of a building to contain ski shop, first aid room, toilets, concession for food and warm drinks and rest area and to move existing building closer to lot Line to be used for maintenance building on the premises, located at west side of Turnpike Street, opposite the corner of Johnson Street. This public hearing was advertised in the Eagle Tribune on August 31 and September 9, 1963. All abutters were duly notified of this hearing by certified mail. Atty. Charles W. Trembly appeared for the petitioner. Robert Dunn, General Manager, was also present. Three persons were recorded in favor. Atty. Leo Terraaano, representing Margaret R. Simon, an immediate abutter, was recorded as opposed. Mr. Burke made a motion to take the petition under advisement, Mr. Drtmmond seconded the motion and the vote was unanimous. On September 23, 1963 The Board of Appeals held an Executive Board meeting and further discussed the petition. Mr. Burke was the only member not present at this meeting. Mr. Morton made a motion to GRANT the variance as explained below. Mr. Drummond seconded the motion and the vote was unanimous. Condition: The petition is granted for the erection of a building, 371 x 1001, in accordance with the plans submitted to the Board and that following said erection, the present refreshment stand shall be moved to the location of the present pump house and shall be modified to conform substantially with the design of the aforesaid new building aid shall be of similar quality and appearance. The foregoing action is taken after the petitioner and his counsel assured this Board that the area in front of the oil-gravel drive-way and parallel to Salem Turnpike, shall be filled, graded, loamed and seeded and hot-top such other area.
