Kindred, trustee of Kindred Family Trust 46 Marbleridge Road N. Andover, MA 01845 DECISION The Board of Appeals held a public hearing on June 9, 1987 on the application of David A. Kindred, trustee of Kindred Family Trust requesting a variance from the requirements of Section 4, Paragraph 4.121(7) and a Special Permit under Section 4.121, Paragraph 7 of the Zoning Bylaws so as to permit continued existence of in- ground pool closer than 10 feet from the lot line, on the premises located at 46 Marbleridge Road, Lot 7B. The following members were present and voting: Frank Serio, Jr. , Chairman, Alfred Frizelle, Vice-chairman, Augustine Nickerson, Clerk, Walter Soule and Raymond Vivenzio. The hearing was advertised in the North Andover Citizen on May 21 and May 28, 1987 and all abutters were notified by regular mail. Attorney Willis spoke for the petitioner stating that the house is located 200' back from the street, and the pool and cabana are at the rear of the house. No objections were received from the neighbors. Upon a motion by Mr. Frizelle and seconded by Mr. Nickerson, the Board VOTED, unanimously, to GRANT the variance and special permit as requested. The Board finds that the petitioner has satisfied the provisions of Section 10, Paragraph 10.3 of the Zoning Bylaws and that the granting of this variance and special permit will not derogate from the intent and purpose of the Zoning ByLaws nor will it adversely affect the neighborhood. As agreed upon, the developer shall deed to the Town of North Andover a 20 foot wide trail around theP erimeter of the site for purposes of pedestrian and equestrian use . This shall he identified on each lot in the definitive plan and reflected in their deed. Deeds of easements shall, be provided to the Planning Board. 15 . The developer shall present to the Board prior to any construction activity, satisfactory documentation regarding earth removal schedule and hours of heavy construction • traffic. A list of contractors working in the subdivision shall be forwarded to the Board for their files . This list shall t,e updated on a monthly basis at the responsibility of the developer . 1.6 . The developer shall not remove more than 50 percent of existing trees within each subdivision lot . This restriction shall be binding on the developer and builder of eah lot . Any tree cutting needed beyond this restriction will require Board approval . As required by the Tree Warden, lots with minimal natural tree coverage shall be provided wi.th new tree plantings .
