N. Andover, MA 01845 DECISION
The Board of Appeals held a public hearing on June 9, 1987 on the application of
David A. Kindred, trustee of Kindred Family Trust requesting a variance from the
requirements of Section 4, Paragraph 4.121(7) and a Special Permit under Section
4.121, Paragraph 7 of the Zoning Bylaws so as to permit continued existence of in-
ground pool closer than 10 feet from the lot line, on the premises located at
46 Marbleridge Road, Lot 7B. The following members were present and voting:
Frank Serio, Jr. , Chairman, Alfred Frizelle, Vice-chairman, Augustine Nickerson,
Clerk, Walter Soule and Raymond Vivenzio.
The hearing was advertised in the North Andover Citizen on May 21 and May 28, 1987
and all abutters were notified by regular mail.
Attorney Willis spoke for the petitioner stating that the house is located 200'
back from the street, and the pool and cabana are at the rear of the house. No
objections were received from the neighbors.
Upon a motion by Mr. Frizelle and seconded by Mr. Nickerson, the Board VOTED,
unanimously, to GRANT the variance and special permit as requested.
The Board finds that the petitioner has satisfied the provisions of Section 10,
Paragraph 10.3 of the Zoning Bylaws and that the granting of this variance and
special permit will not derogate from the intent and purpose of the Zoning ByLaws
nor will it adversely affect the neighborhood.

The North Andover Planning Board has voted to APPROVE said plan, subject to the
following conditions:
1. That the record owners of the subject land forthwith execute and record
a "covenant running with the land", or otherwise provide security for the con—
struction of ways and the installation of municipal services within said sub-
division# all as provided by G.L. c. 419 S. 61—U.
2. That all such construction and installations shall in all respects
conform to the governing rules and regulations of this Board.
3. That, as required by the North Andover Board of Health in its report to
this Board# no building or other structure shall be built or placed upon Lots
No. 1 through 11 as shown on said Plan without the prior
consent of said Board of Health.
4. Other conditions:
A. All Planning Board order of conditions are to be placed on the
recorded definitive plan, prior to signature at a Planning
Board meeting.
B. Prior to signing the definitive plans all executed deeds of
easements and parcels shall be submitted to the Planning Board
and held in escrow until completion. At the time of completion
and prior to final security release, the developer shall execute
such documents for the Town.
C. A certified document shall be submitted to the Planning Board
after the completion of each phase verifying that all utilities
(including electric, sewer, telephone and cable) have been
installed prior to binder coat application. Installation shall be
in accordance with plans and profile prior to the release of
any lots .
In the event that no appeal shall have been taken from said approval within
twenty days from this date# the North Andover Planning Board will forthwith
thereafter endorse its formal approval upon said plan.

The Rules: Shall mean the Rules and Regulations Governing the
Subivision of Land - North Andover, MA issued by said Board

Plan of "Oakwoorl" prepared by Thomas E. Neve Associates, 447

14 . As agreed upon, the developer shall deed to the Town of
North Andover a 20 foot wide trail around theP erimeter of
the site for purposes of pedestrian and equestrian use .
This shall he identified on each lot in the definitive plan
and reflected in their deed. Deeds of easements shall, be
provided to the Planning Board.
15 . The developer shall present to the Board prior to any
construction activity, satisfactory documentation regarding
earth removal schedule and hours of heavy construction
• traffic. A list of contractors working in the subdivision
shall be forwarded to the Board for their files . This list
shall t,e updated on a monthly basis at the responsibility of
the developer .
1.6 . The developer shall not remove more than 50 percent of
existing trees within each subdivision lot . This
restriction shall be binding on the developer and builder of
eah lot . Any tree cutting needed beyond this restriction
will require Board approval . As required by the Tree
Warden, lots with minimal natural tree coverage shall be
provided wi.th new tree plantings . Number and size of trees
to be planted steal ' be at the discretion of the Tree
Department .
17 . The owner/applicant/developer shall. be aware of the fact
that approval of this subdivision under thge Board ' s Rules
will not relieve said parties of the responsibility to other
property owners upon whose land may be affected by indirect
or di.r. ect development storm water discharge.
18 . In accordance with the Board of Fu-)]Ac Works :
The water main on Jennifer Road shall be 8" class 52
ductile iron cement lined water pipe installed 10 feet
right of the centerline of the road with S feet of cover
below the finish grade from the existing water main on Ash
Street to station 13 + 20.
A 1.2" x 8" tapping sleeve and gate valve shall. be provided
at the existing water main on Ash Street .
Ed(ly breakfl.ange hydrants to North Andover specifications
are to be installed at station 5 + 20, 9 + 50 and 13 + 2.0 .
A 20 ' foot wide utility easement shall be provided between
the end of Jennifer. Road and Farnum St . to insure a route
for any future water main extensions .
- All hydrant branches shall be provided with six inch
Mueller or equal gate valves (open Left. )
All gate valves shall comply with AWWA specifications L500
52T and will be supplied with a 100 lb. sliding type gate
box marked "WATER. "
All water mains shall pass leakage an pressure tests
performed in accordance with section 13 of the AWWA
stanria,-d C600 and shall be chlorinated in accordance with
AWWA C601 "Standard Procedure for Disinfecting Water
Mains. "
