Dear Sir: A public hearing was held by the Board of Appeals on October 18, 1971 upon appli- cation of J. & V. REALTY TRUST who requested a variation of Section 6.31 of the Zoning By-Law so as to permit a variance on the frontage of Lot 9A Surrey Drive, from 100 feet to 90 feet; on the premises located at the east side of Surrey Drive, approx. 330 feet from the corner of Chadwick Street and known as Lot 9A Surrey Drive. The following members were present and voting: J. Philip Arsenault, Esq., , Chairman; Kenneth E. Pickard, Vice Chairman; Dr. Eugene A. Beliveau, Secretary; Artbur R. Drummond and Associate Member William N. Salemme who sat in place of regular member Frank Serio, Jr. The hearing was advertised in the Lawrence Eagle-Tribune on October 2 & 9, 1971 and all abutters were duly notified by regular mail. Mr. Vincent McAloon spoke, representing the petitioner, and explained that the lot lines of the subdivision are at an angle and that after the house was built they found that a driveway could not be placed properly so that they want to give 10 feet additional frontage to lot 10A which would leave a frontage of 90 feet on lot 9A. Frank Arcidiacono, owner of the lot, was recorded in favor of the petition. No one else spoke and there was no opposition. The petition was taken under advisement and during this period was reviewed by the Board. Mr. Drummond made a motion to GRANT the variance; Mr. Pickard seconded the motion and the vote was unanimous. The Board found that a ten foot variance was not substantial enough to violate the intent and purpose of the By-Law. That after the granting of the variance, the total frontage of the two adjacent lots in question would not change and the variance involved only the allocation of the extra ten feet to one lot as opposed to the other. The Board found hardship to the extent that the owner of the building would have difficulty using his garage if the variance was not granted. Dear Sir: The following petition was heard at a meeting of the Planning Board on Monday evening, March 6, 1972 at 7:30 P.M. in the Town Office Building. The following members were present and voting: Charles W. Trombly, Jr., Chairman; Donald N. Keirstead, Vice Chairman; John J. Monteiro, Secretary; William Chepulis and Robert J. Burke. J. & V. REALTY TRUST petitioned to subdivide a parcel of land containing approximately 6 acres on Chestnut Street between Longwood Avenue and land of Kurtz Hanson. The definitive subdivision plan showed 5 lots, all of which met the requirements of the Subdivision Control Law and to be called "Chestnut Court". John J. Burke represented J. & V. Realty,Trust and explained that single family homes would be built costing in the vicinity of $50,000. Philip Busby, Jr. is the engineer. A letter was re— ceived from the Board of Public Works stating that the water and sewer lines met that Board's specifications. The Highway Surveyor also approved the plans with the understanding that 300 feet of 12" aluminum pipe will be furnished by J. & V. Realty Trust to correct existing drainage. Mr. Burke stated that they would comply with Mr. Nicetta's request. No one else spoke and there was no opposition. Mr. Chepulis made a motion to APPROVE the subdivision subject to certain conditions as listed below. Mr. Monteiro seconded the motion. Mr. Burke disqualified himself from voting and the vote was 4-0. The conditions are as follows: 1. That the record owners of the subject land execute and record a "covenant running with the land" within 20 days from the date of this decision, or otherwise provide security for the construction of ways and the installation of municipal services within said subdivision, all as provided by G.L. c. 41, s. gl--U. 2. Dear Sir: A public hearing was hjld by the Board of Appeals on January 12, 1976 upon application of J & V Realty Trust who requested a variation of Section 6.2 and Table 2 of the Zoning $y-Law so as to permit relocation of property lines for proper siting on the premises located at the north side of Rea St., 310 feet from the corner of Johnson St, and known as Lots 3 & 4 shown on a plan of land accompanying the petition. The following members were present and voting: Alfred E. Frizelle, Vice-Chairman; Louis DiFrascio, Clerk; James D. Noble, Jr., Frank Serio, Jr., Chairman; and Walter Jamitkowski, Assoo. Member. The hearing was advertised in the Lawrence Eagle-Tribune on Nov. 22 & 29, 1975 and all abutters wore'duly notified by regular mail. The petitioner seeks a variance from the provisions of Section 6.2 and Table 2 of the By-Law to enable it to divide Lots 3 & 4 on Rea Street thereby making one lot having less than ;the required frontage. There was no opposition. A motion was made by Mr. DiPruscio to grant the variance and seconded by Mr. Noble.
