Dear Sir:
A public hearing was held by the Board of Appeals on October 16, 1978 upon application
of David M. & Sharon L. Knepper who requested a variation of Sec. 6.3 and Table 2 of
the Zoning By Iaw so as to permit an approximate 6 ft. setback variance from the side-
line as shown on a plan of land dated October 1978 and located at 440 Boston St. The
following members were present and voting: Frank Serio, Jr., Chairman; R. Louis
DFruscio, Clerk; James D. Noble, Jr.; John J. Gaffny, III; and Assoc. Member Richard
J. Trepanier.
The hearing was advertised in the Lawrence Eagle-Tribune on Sept. 30 & Oct.71 1978
and all abutters were duly notified by regular mail.
As a result of testimony presented to it at the public hearing, the Board found that
when the petitioner purchased the property he assumed the house met all zoning require-
ments. Now that he wishes to sell the property and the financing institutions require
certification that all zoning requirements are complied with, the Kneppezb requested a
side line variance to allow the as built 24 ft. setback vs. the required 30 ft.
The Board found that a denial of this variance request would indeed be a financial
hardship to the petitioner as he would not be able to sell the house. The Board further
found that due to the topography of the area, the size and location of other homes in
the area that :to. grant the petition would not be detrimental to the area in general and
would not derogate from the intent and purpose of the North Andover Zoning By-Law.
Therefore, on a motion made by Mr. Noble, seconded by Mr. Gaffny the Board voted unani-
mously to grant the petition as requested.
