NELSON, DIRECTOR September 2, 1987 Mr. iDaniel Long, Town Clerk Town Office 120 Main Street North Andover, MA 01845 Re: Knightbridge Partners, Inc. 800 Turnpike Street North Andover, MA 01845 Site Plan Review through Special Permit Dear Mr. Long: The North Andover Planning Board opened the public hearing on Monday evening, July 6, 1987, in the Town Office Meeting Room upon the application of Daniel J. Murphy and Jane Walsh, of Knightbridge Partners, Inc. regarding the referenced matter. The following members were present at the July 61 1987 meeting: Erich Nitzsche, Chairman; John L. Simons, Clerk; Paul Hedstrom; George Perna and John J. Burke. The petitioner seeks a Special Permit under Section 8, Para.3, Site Plan Review. The purpose of the Site Plan application is to review the proposal to renovate existing offices and to construct a 5,500 square foot, two story addition to the existing building on a 50,000 square foot parcel of land on the south side of 89 Turnpike Street in a Business-4 (B-4) Zoning District. John Simons read the legal notice and opened the public hearing. Stephen Stapanski, Engineer and Frank Chaney, Arch&tect were present along with the applicant and provided architectural and engineering input. Prior to Mr. Stapanski ' s presentation, letters from the Board of Health, the Conservation Commission, the Fire Department, the Police Department and the Building Inspector were read into the record. The following matters were discussed: The Northmark Bank project is proposed for development in North Andover, Massachusetts. As indicated by the developer, the facility would be a private financial institution serving the needs of a select clientele. These clients would be served via scheduled appointments only. The bank would not be used by the general public. Page 2: The project site is located on Ro R 1 1b4� em Turnpike, ro 4� pj approximately .2 of a mile West of the four-way signalized intersection of Route 114 and Route jtt.3 R8gW_J!4#7is a heavily traveled two way, two lane ar erial roa way. It extends through the Town of North Andover in a general Northwest/Southeast direction. The site is occupied by a two story brick building and paved circular driveway. The building is comprised of approximately 3,700 square feet of general office space. Vehicular access and egress to the building is provided by two driveways intersecting Route 114 . These driveways are located approximately 140 feet apart. As shown on the site plan, the proposed development involves the construction of a two story wood framed structure that would be attached to the existing brick building. This addition would be be comprised of approximately 5,500 square feet, and would be used for general office space. The two driveways serving the existing building would be designed for one-way traffic movement entering and exiting the site respectively. Additional pavement material would be used to extend the existing driveway around the - proposed building. The new pavement area would provide parking accommodations for 31 vehicles. In addition, it was pointed out, by applicant' s advisors, that lighting as proposed would not affect abutters or Route 114 and parking would be buffered by large trees and that the stone wall would be preserved. Traffic issues were raised by the Planning Board and by Joe D'Angelo, Danvers District of the Mass. D.P.W. The architect said that: 1) size, scale and massing will be compatible to existing building and be in keeping with historical character thereof. 2) material, coloring of addition, to be compatible and as per detail submitted to the Board. The following members were present and voting at the August 31 , 1987 meeting when the Board rendered its decision: Erich W. Nitzsche, Chairman; John L. Simons, Clerk; George Perna; John J. Burke and Paul Hedstrom. MOTION: By Paul Hedstrom to approve conditionally per decision. SECOND: John Simons VOTE: Unanimous To conditionally grant the application for site plan approval under the Special Permit process for Knightbridge Partners, Inc. subject to the following: 1) The Planning Board has determined that because the Board of Appeals has granted to the applicant the variances which they requested in that hearing process, the records of which are incorparated herein by referencing the proposed use is permitted at the site in accordance with the Zoning Bylaw. Page 3: 2) Applicant shall comply with the Fire Departments recommendations of July 3, 1987 and the concerns raised by the Police Department as set forth in correspondence of June 23, 1987 shall also be satisfied. 3) All matters set forth in the Site Development Plan submitted with this application and dated July, 1987 and revised August 7, 1987 by Merrimack Engineering Services are incorporated in this approval by reference and shall be complied with. 4) Lighting shall be indirect and non intrusive to neighbors and Route 114. 5) The non-retail banking activity and the reduced traffic which would be accompanied with such a use, all as described by the applicant whould be maintained as the Board has concerns regarding a retail traffic flow in the subject location. As built plans will be submitted to the Planning Board - for approval prior to the issuance of an occupancy permit. T& conditionally granting this Special Permit, the Planning Board minds pursuant to the relivant bylaws the following: 00 1) The site is an appropriate location for such use. T7, ZIm The USE, non-retail banking and general office will not adversely affect the neighborhood. 3) There will be no nuisance or serious hazard to vehicle traffic or pedestrians if the applicant abides by the conditions of the approval. 4) Adequate and appropriate facilities for water, sewer, parking, traffic and landscaping will be provided for the proper operation of the proposed uses . Based on site visits, the public hearing process, and reviews from outside agencies, the Planning Board will permit the proposed use to be considered in harmony with the general purpose and intent of the Zoning Bylaw. AC14 L:A TOWN OF NORTH ANDOVER 33 MASSACHUSETTS BOARD OF APPEALS Knightsbridge Partners, Inc.* Petition: 80-88 800 Turnpike Street North Andover, mA 01845 DECISION The Board of Appeals held a public hearing on July 27, 1987 and July 31, 1987 on the application of Knightsbridge Partners, Inc. requesting a variation from the requirements of Section 7, Paragraph 7.1, 7.3 and Table 2 of the zoning bylaws so as to permit relief from 100 foot side and rear setbacks and from 50 .feet "green" buffer zone and from lot area requirements. The following members were present and voting: Frank Serio, Jr. , Chairman, Augustine Nickerson, Clerk, William Sullivan, Walter Soule and Anna O'Connor. The hearing was advertised in the North Andover Citizen on July 9 and July 16, 1987 and all abutters were notified by regular mail. Attorney for the petitioner stated that they want to put an addition on to the existing building. The addition will blend into the historic style of the brick building there now and would not be visable from the street. The primary use of the entire building would be for banking offices. Upon a motion made by Anna O'Connor and seconded by Walter Soule, the Board VOTED to GRANT the variances as requested, with the condition that green shrubbery be put on the North side of the property. The vote was as follows: In favor, Frank Serio, Jr. , William Sullivan, Walter Soule, and Anna O'Connor. Opposed was Augustine Nickerson. The Board finds that the petitioner has satisfied the provisions of Section 10, Paragraph 10.4 of the Zoning ByLaws and the granting of these variances will not derogate from the intent and purposes of the Zoning ByLaws nor will it adversely affect the neighborhood.
