Counsel Salisbury disagreed with the statement made hy Attorney Thomson.
MrS Salisbury stated that the Board should decline to take action because of the l0t on
the side 'line. He brought out that the only facts presented by the proponent is the
presented plan.
Counsel Thomson s~id it was irresPective to which line to take. As for the north east
bound of the drive way, it may not always appeared t~at way when the use of the metal
garage said~ to be since 1918~may be within,' the 20 year period they began to use th~s
driveway. Once again he stated he did not believe it was a matter for, the B~mrd of Appeals
by the land court.
Mr. Nicetta made a motion, seconded by Mr. Lund that ~he petition be taken under advisement.
It was unanimously voted.
Board siSned vouchers for the clerk's salary, and Mr. Kent.
Meeting adjourned at 8:35 p. m.

Special Meeting
The meeting was called to order at 7:30 p. m. Members present: R-l. ph Finck, Chairman,
Alfred Boeglin, Secretary, Kenneth Terroux, Henry Lund, Nicholas Nicetta and Associate'
Member, Daniel O'Leary.
The application of Effie Konstandin, proprietor of Ch-~les Staak House was taken up
first by the Board.
There was some discussion as to whether hardship for which the petitioner based his
application was actually correct.
This eatery is a non-conforming use.
Mr. N~cetta stated he was against granting this variance.
Mr. O'Leary m_~de a motion to deny the petition based on the estimation of the Board, in
the present By-law such being a matter for the Planning Board and not the Board of Appeals.
Mr. Terroux seconded this motion. It was so voted unanimously.
The application of Harold Morley~ Jr, was second on the agenda. Mr. Terroux made a motio~
senconded ~y Mr. Beoglin to grant the variance. It was unanimously voted.
The petition of Howard Camuso was granted by motion made by Mr. Nicetta that the petitioner
has met all the requirements, except the variance of 3' on the side line and the variance
shotuld ~e granted~ Mr. O'leary seconded this motion.
The application of Mauriee Sergi who ~ ~d~m~ to erect a garage with a breezeway was taken
up by the Board. A motion was made by Mr. Nicetta, seconded by Mr. Ol~.eary that the
