William Kochanczyk Town Office Building 61 Sylvan Terrace North Andover , Mass . 01845 Petition No. 34- ' 84 Dear Mr. Long: The Board of Appeals held a public hearing on Monday evening, June 11 , 1984 upon the application of A. William Kochanczyk. The hearing was advertised in the North Andover Citizen on May 24 and 31, 1984 and all abutters were notified by regular mail . The following members were present and voting: Alfred E. Frizelle, Esq. , Vice Chairman; William J. Sullivan; Augustine W. Nickerson; Walter F. Soule ; and Maurice S. Foulds. The petitioner seeks a variance from the provisions of Section 7, Paragraph 7 .3 and Table 2 of the Zoning By Law so as to permit relief from the side and rear setback requirements to allow the constructin of an addition. The petitioner testified that he would like to add a one and one- half stall garage to his existing dwelling. The proposed addition will not meet the side or rear setback requirements of the Zoning By Law in the R-4 zoning district. The addition is needed to protect his automobiles and to provide storage. The addition cannot be placed elsewhere on the lot . No opposition was voiced at the hearing. y' A. The Board finds that Section 10.4 of the Zoning By Law has been satisfied . In particular, the Board finds that the proposed addition in its proposed location will not adversely affect the neighborhood nor will it substantially derogate from the intent and purpose of the Zoning By Law. Any communication purporting to be an application shall be treated as mere notice of intention to seek relief until such time as it is made on the official application form. Petition of: * William Kochanczyk * Petition # 52-87 61 Sylvan Terrace * DECISION * * * * * * * * * The Board of Appeals held a public hearing on April 14, 1987 on the application of A. William Kochanczyk requesting a variance from the requirements of Section 7, Paragraph 7.3 and Table 2 of the Zoning By-Laws so as to permit relief of the rear yard setback requirements for exiting deck and relief from one (1) foot front setback on the premises located at 61 Sylvan Terrace. The following members were present and voting: Frank Serio, Jr. , Chairman, Alfred Frizelle, Vice-chairman, Augustine Nickerson, Clerk, Walter Soule and Anna O'Connor. The hearing was advertised in the North Andover Citizen March 26 and April 2, 1987 and all abutters were notified by regular mail. The petitioner presented evidence that he had purchased the property in 1979 with out any problem, but when we applied for refinancing, the bank refused until a variance was granted for the rear yard setback. Upon a motion made by Mr. Frizelle and seconded by Mr. Soule, the Board VOTED to GRANT the variance as requested. The vote was unanimous. The Board finds that the petitioner has satisfied the provisions of Section 10, Paragraph 10.4 of the Zoning By-Laws and the granting of this variance in particular will not derogate from the intent and purpose of the Zoning By-Law nor will it adversely affect the neighborhood.
