Dear Sir: The Board of Appeals held a public hearing on Monday evening, December 8, 1969 at 7:30 P.M. at the Town Office Building with the following members present and voting: Arthur R. Drummond, Chairman; Daniel T. O'Leary, Secretary; Donald J, Leonard, Donald J. Scott and Associate Member James A. Glynn, Jr., Esq, Robert A. Koralishnrequested a variation of Sec. 6.33 of the Zoning By-Law so as to permit the erection of a single family dwelling on the premises, located at the east side of Ferneroft Circle, known as Lot #20. This public hearing was advertised in the Lawrence Eagle-Tribune on November 24 & 299 1969 and all abutters were duly notified by certified mail. Atty. Harold Morley, Jr. represented the petitioner and explained that the road- way continuing from the turnaround as shown on the subdivision plan would never be hot-topped and finished thereby leaving a frontage of 52.48 feet on this particular lot and that the petitioner could possibly have difficulty when trans— ferring the property at some later date. Letters were received from the Planning Board and the Building Inspector both stating that it is a legal lot and that a building permit would be issued if applied for and that no action by the Board of Appeals is necessary. The petition was taken under advisement until an opinion was received from Town Counsel. At their meeting of January 12, 1970, with four of the original members present and voting (Donald J. Scott was unable to attend), upon motion by Member Leonard and Board voted unanimously seconded by Associate Member Glyn, the that the Board of Appeals has no jurisdiction over this matter and that the petitioner may withdraw it since no action is necessary by this Board.
